Harrison Gharama Kombe, MP for Magarini, has lost his seat following a Friday morning judgement by the Malindi High Court.
In the August 9 General Election, Mr Kombe was elected on an ODM ticket.
When invalidating Mr Kombe’s victory, the court noted that the election was marred by major irregularities.
The Malindi High Court determined that a by-election should be held following substantial irregularities such as voter stuffing, reduction, and interchanging of results in favour of the IEBC’s announced winner and that a new mini-poll be held.
Stanley Kenga, a UDA candidate, had petitioned, questioning Garama’s victory.
Mr Kombe was victorious by a razor-thin margin, followed by Mr Kenga.
