It’s Unconstitutional – High Court Rules on Sh7 Hike Road Maintenance Levy

Another blow to the Government as the Judiciary stamps her Authority by halting the increment of Road Maintenance Levy as earlier on proposed by the Government.

Today the High Court issued orders barring the government from increasing the Road Maintenance Levy Fund (RMFL) after a petitioner moved to court to challenging the proposal.

According to George Odhiambo Juma, the Petitioner, the move by the Government to increase the levy from Ksh.18 to Ksh.25 in the June-July was against the Law.

He further said that the levy which came into effect in July is unconstitutional since there was no meaningful and adequate public participation.

The High Court agreed with the petitioner that indeed fundamental human rights were never adhered to hence suspending the proposal’

“Pending the hearing of the Notice of Motion dated 2nd August 2024 interprets, a conservatory order is hereby issued, restraining the Respondents, either jointly and or severally, whether by themselves, their officers, agents, employees or other person or entity acting under the Respondents’ instructions, from implementing and enforcing the Road Maintenance Levy Fund (Imposition) Order 2024,” reads the order.

The levy is charged at the pump for every litre of petrol or kerosene that a motorist purchases.
