Dennis Itumbi, a digital strategist, now wants the Ethics and Anti-Corruption Commission to complete its inquiry into the ‘State”s’ improper acquisition of public land in Nairobi in 2017.
Itumbi also wants the Director of Public Prosecutions to prosecute those involved in the case over the alleged loss of Ksh 1.5 billion.
Former Interior Cabinet Secretary Dr. Fred Matiang’i is being accused by Itumbi of being the architect behind the unlawful acquisition of a 13-acre plot of land where Ruaraka High School and Drive Inn Primary School are located.
According to Itumbi, the land previously belonged to the state, and the forceful acquisition by the Ministry of Education, then led by Dr. Matiang’i, was illegal, resulting in Kenyans losing money.
Itumbi expressed concern in letters prepared by the law company representing him, Waithera Kinuthia & Company Advocates, that the two state authorities had been unwilling to finalize investigations and eventual prosecution, despite promising to do so.
“Our client would like to remind you that the Commission under Section II of the Anti-Corruption and Economic Crimes Act is mandated to investigate and recommend to the Director of Public Prosecutions of any acts of corruption or violation of codes of ethics or other prescribed under the ACECA or any other law enacted pursuant to Chapter Six of the Constitution,”
“It is now three years since the file was returned to you by the Office of Director of Public Prosecutions for more investigations to be conducted but it appears there wass no urgency in conducting the investigations as Kes 1,500,000,000 is pocket change to the Kenyan taxpayers who are so wealthy that its loss would not bother their conscience or economic situation,” Itumbi said in a letter to the EACC.
