The tribunal investigating Justice Chitembwe’s case has recommended that the High Court Judge Justice Said Juma Chitembwe, who was under investigation, be removed.
The tribunal’s findings were handed to President William Ruto on Tuesday afternoon.
Former President Uhuru Kenyatta constituted the tribunal in April of 2022 to investigate Justice Chitembwe’s conduct.
The Judicial Service Commission (JSC) had recommended that Justice Chitembwe be dismissed from office due to leaked footage depicting him in a plan to compromise an ongoing court case.
Uhuru then suspended Justice Chitembwe and appointed a tribunal to assess his fitness for the job.
The tribunal, presided over by appellate judge Mumbi Ngugi, was entrusted with re-evaluating the evidence that informed the Judicial Service Commission’s recommendation to remove Justice Chitembwe.
Senior Counsel Fred Ojiambo, High Court judge Abida Ali Aroni, Labour Relations Court judge Nzioki Makau, and lawyer James Ochieng’ Oduol were among those on the tribunal.
Lt Gen Jackson Ndung’u, former Kenya Air Force Deputy Commander, and Lydia Nzomo, former Teachers Service Commission chairperson, were also members.
However, the tribunal in a majority ruling recommended the removal of Justice Juma Chitembwe.
