A director of Zion Ahadi Mediclinic Limited has been arraigned before the Milimani Law Courts and charged with multiple offences related to the alleged misappropriation of public health funds amounting to Ksh 2.59 million.
Josephat Ouma Omoto appeared in court facing seven counts, including misappropriation of funds, falsification of health documents, acquisition and use of proceeds of crime and uttering false documents, all linked to claims made to the Social Health Authority (SHA).
According to the charge sheet, Omoto is accused of misappropriating Ksh 2,591,125 between 1 January 2025 and 30 June 2025 by inducing SHA to pay the amount to Zion Ahadi Mediclinic Limited for inpatient and maternity services which the facility was not contracted to provide, contrary to Section 48(2) of the Social Health Insurance Act.
In a separate count, the prosecution alleges that during the same period, Omoto knowingly and fraudulently falsified medical documents by inserting patient details to falsely represent that patients had consented to or undergone treatment, with the intention of defrauding SHA and unlawfully obtaining benefits under the Act.
The accused is further charged with acquiring proceeds of crime contrary to Section 4(a) as read with Section 16(1) of the Proceeds of Crime and Anti-Money Laundering Act (POCAMLA).
The court heard that Omoto and Zion Ahadi Mediclinic Limited allegedly received the KSh 2.59 million through a Cooperative Bank account, while knowing or having reason to believe that the funds constituted proceeds of criminal activity.
Another count accuses Omoto of using the said funds, contrary to Section 4(b) as read with Section 16(1) of POCAMLA, after allegedly knowing that the money formed part of the proceeds of crime.
The prosecution also preferred three counts of uttering false documents contrary to Section 353 of the Penal Code.
Omoto is accused of knowingly presenting falsified discharge summaries to SHA while purporting them to be genuine documents.
He pleaded not guilty to all charges.
The documents relate to inpatient claims for Florence Rachael Atero, Elida Omunyokho Omukoyia and Milka Omwaka Winnie, allegedly submitted on different dates between January and March 2025.
The accused was arrested on 8 January 2026 and presented before court the following day.
The matter is set to proceed on Monday, 12,January, 2026.
