Karua Moves To The East African Court Over Supreme Ruling

Narc-Kenya party leader Martha Karua has petitioned the East African Court of Justice to overturn the Supreme Court’s ruling on the 2022 general election petition.

Karua, who was former premier Raila Odinga’s running mate in the 2022 presidential election, is seeking an alternative opinion on the grievances she raised against IEBC and President William Ruto at the Apex Court in her application alongside Director of Muslims for Human Rights (MUHURI) Khelef Khalifa.

According to court documents, Karua and Khalifa are relying on the EACJ to argue that the two organs’ actions and decisions violated their rights.

“Their joint Reference claims that Kenya’s Independent Electoral and Boundaries Commission (IEBC), failed to properly manage the August 2022 elections by ceding critical aspects of the process such as the electoral technology and results management to persons it had no control over,” part of the petition read.

The two also claim that the Supreme Court let them down in their quest for a fair trial by failing to compel IEBC to provide all of the information required to vindicate their rights.

In their submissions, Karua and Khalifa also claimed that the Supreme Court refused to examine all of the evidence presented to it, failed to fully investigate the technology used, and condoned IEBC’s cover-up by refusing to grant access to its critical technology critical to determining the matter fairly, despite its own orders.
