Two Chinese businessmen are locked in a battle over possession of Nairobi’s Kindaruma Mall situated along Ngong Road.
Chen De, the director of Kindaruma Mall Limited, asserts that he invested Ksh.40 million and another Ksh.50 million in accordance with the agreement, and that the mall was built as planned.
De claims that Shao Guixiang, director of Good Choice Garage Limited, sought him to help in the development of a shopping mall in Nairobi because he had run into financial problems and needed aid with the construction.
In court papers, De claims that Guixiang colluded to mislead the court in a bid to deny him the right to the property adding that at all times during the construction of the mall and issuance of license to the tenants, the complainant was well aware of the agreement between its directors and him.
“That Shao Guixiang had earlier constructed 30 % of the plan and required my intervention to complete the mall,” reads the papers.
The Mall director claims that on May 9, 2022, a meeting was convened, and it was then agreed that he invests Ksh.40 million to complete the mall and that it is in the meeting that the agreed that they would from joint venture company in the name of Kindaruma Mall Limited.
“The purpose of our joint investment in the construction and that the lease on the land would be transferred to the company that Kindaruma Mall was indeed registered, and Shao Guixiang nominated his daughter Shao Zhujun to hold his shared on his behalf,” reads the affidavit.
He says that tenants had been duly remitting rent to Kindaruma Mall Limited, however on January 30, 2023, Good Choice Garage Limited went allegedly issued a 24-hour eviction notice.
