Former Ranch Board Chairman Admits To Controversial Konza Land Sale

Ngilai admitted signing approval in the sale of the 5,000 acres of land to the ministry of information and communication between February 2, 2009, and January 11, 2010.

Former Malili Ranch board chairman, David Ndolo Ngilai has admitted to signing a land sale and transfer agreement leading to a fraudulent loss of Ksh 1 billion to the Government for Konza City project development.

He was appearing before the Milimani Anti-Corruption Court Magistrate Lawrence Mugambi.

Ngilai admitted signing approval in the sale of the 5,000 acres of land to the ministry of information and communication between February 2, 2009, and January 11, 2010.

Ngilai signed the above transfer without a resolution from all the other shareholders as required by Law.

In cross-examination by the state Lawyers, he conceded to having signed the transfer agreement despite being aware the government had purchased the land.

He further said the Government compensation fund of Ksh 1 billion towards the acquisition of the land to develop the technological city was received through the account of Advocate Erick Mutua.

He also told the court that the ranch board members approved payment of KSH 28 million as legal fees for the valuers contracted to evaluate the property of those who had settled and developed the land without the members’ resolution.

Ngilai is charged alongside Leonard Kyania Kitua and Julius Mbau Nzyuko with six counts of Conspiracy to defraud Ksh 553,831,731 being the sale proceeds of the land and breach of trust in the sale of the land without shareholders resolution.

The prosecution has so far presented a total of 31 witnesses to prove the case against the three Malili Ranch Directors.
