Two men in Makueni County were sentenced to 20 years in prison over the offence of sodomy.
The two; Daniel Kiio Mutua and Samuel Mwendo Kiio were charged with gangraping a mentally disabled boy in Makueni County.
The two are said to have trailed the said young man in Makindu town where they raped him uncontrollably.
He has later discovered the following morning unconscious and rushed to the hospital.
The prosecution side staged a number of witnesses whose testimony corroborated resulting in a conviction.
The learned magistrate ruled that indeed the prosecution had proved their case beyond a reasonable doubt.
“I am satisfied that the evidence tabled before this court was conclusive. In an offence of sexual assault, the victim is the primary witness and in some cases the only witness, in this case, the victim was mentally incapacitated and therefore this court relied on evidence and testimony from the forensic examination.”
“The DNA swaps matched the suspects and therefore am satisfied that the suspects indeed committed the offence. I will therefore sentence the accused to serve 20 years in prison.
The convicts have been given 14 days to appeal.
