A Nairobi court has released a 30-year-old man charged with publishing false information online after he pleaded not guilty to the offence at the Milimani Law Courts.
Boniface Mulinge Muteti was arraigned before the court and charged under Section 23 of the Computer Misuse and Cybercrime Act No. 5 of 2018.
Prosecutors allege that on December 6, 2025, Muteti used his X (formerly Twitter) account @mulinge_muteti to publish information he knew to be false and likely to cause fear, alarm, or violence among members of the public.
According to the prosecution, Muteti is accused of tweeting statements claiming that politicians had not worked, innovated, or invented anything, and that all they owned had been stolen from Kenyans.
In the alleged tweet, he wrote: “If you come across anything owned by politicians, anza kuchukua, these people have never worked anywhere, innovated or invented anything. Everything they own was stolen from Kenyans and must be returned to Kenyans. Arm yourselves and prepare for the coming uprising.”
The prosecution told the court that the message was calculated to incite unrest and violence, and that investigations were conducted by officers from the Directorate of Criminal Investigations (DCI) Serious Crimes Unit.
Muteti denied the charge when it was read to him.
His lawyer asked the court to grant him lenient bond terms, arguing that the accused is not a flight risk and that the prosecution had failed to demonstrate otherwise.
The defence further submitted that Muteti would be available to attend court whenever required.
The court was informed that Muteti was arrested on December 12, 2025, and was denied police cash bail, remaining in custody until his court appearance.
After considering submissions from both sides, the court granted Muteti a cash bail of KSh 15,000, with the requirement of one contact person.
The magistrate also ordered the prosecution to supply the defence with all materials to be relied upon in the case, including witness statements.
The matter is scheduled for pre-trial on December 30, 2025, as the case proceeds to hearing.
