Philip Murgor, the lawyer for rally star Maxine Wahome, told the court that Maxine was in an abusive relationship with her late partner Asad Khan.
During a bail hearing on Tuesday, Murgor stated that Maxine was “brutally assaulted” and did not murder Asad.
The lawyer said that on the fateful day, Maxine contacted her mother and asked her to call the police because her life was in danger.
“She opted to contact her mother, and the police officer says that’s not normal… it’s common in Kenya, nowadays the last person you call is the police,” Murgor told the court.
The lawyer further claimed that the late rally driver tricked Maxine and benefited from her success.
“This young lady was in the relationship when she was 22, it was the deceased who tricked her down; she was a nursery school teacher and ended up in rallying because of her father. The deceased was a mechanic who helped her get the car and when she got famous all her sponsorship money went to the deceased and the brother,” he said.
Murgor added that Maxine has nothing now and very little money in her bank account as “her sponsorship used to go direct to the deceased.”
The lawyer told court that Maxine should be released on bail, and put under the custody of her parents since she cannot interfere with investigations.
“The deceased was 50 years old so when they say she will interfere with the witnesses… look at the age gap of the accused and the brothers who are yet to testify… can she interfere with the witnesses?” Murgor submitted.
