Two men have been sentenced to 30 years in prison after they were convicted of robbery with violence contrary to the law.
The two; Antony Ekhai Mwaiti and Kennedy Karanja Mungai were found guilty of robbing Simon Michael Kanyi his motor vehicle valued at Ksh 550,000 and a phone valued at Ksh 2,000.
According to the charge sheet, the two convicts on March 3, 2016, at the southern bypass near Ole Sereni hotel in Nairobi, jointly while armed with a knife, robbed the complainant of his motor vehicle and a phone.
The two are said to have used actual violence at the time of the crime.
They were also charged with handling stolen goods where they retained the stolen vehicle and the phone.
Facts surrounding the robbery
The two convicts on the 3rd day of March 2016 at about 1700hours, went to Kilimani hotel where they hired a Taxi to take them to Ole Sereni hotel at a Court called Bonia Court.
They were armed with a knife and a piece of Manila paper, and the owner of the Taxi agreed to drive them to Bonia Courts.
On reaching Bonia Courts, the driver stopped the car for his customers to alight, instead the convicts tied a piece of rope around the neck of the driver threatening to stab him if he does not cooperate.
They, later on, proceeded to cut his finger, removed him from the car, and dumped him in a hall having tied his legs with a rope.
The court ruled that indeed the offense of robbery with violence had been proved beyond reasonable doubt by the prosecution.
It further ruled that the offense in question is a capital offense that carries a serious sentence.
In mitigation, the convicts pleaded with Principal Magistrate Bernard Ochoi to pass a lenient sentence stating that they have so far served seven years in custody after the court denied them bond.
The court in sentencing noted that the victim in the case was put in a sack and thrown along the Highway. The court further ruled that it had considered the fact the convicts had already served 7 years in prison it was convinced that indeed 30 years was the most appropriate sentence.
