Nairobi Employment and Labour relations court ruled that it is usurpation of Judicial Jurisdiction powers to charge her outside the region she is alleged to have contravened the law.
Linet Chepkorir, aka Toto, Bomet women representative, was hauled in court on claims of nepotism in which she is accused of hiring six of her family members.
Employment and Labor Relations Judge James Toka ordered that the complaint brought against Toto be heard in Bomet.
The court ruled that there is no justification for the petition to be filed in Nairobi and that the case should be transferred to Eldoret Employment and Labour Relations Court.
In this case, two petitioners accuse Toto of nepotism.
They claim that six of the people named as interested parties in the lawsuit work as support staff in various divisions of the office of the Bomet County Woman Representative.
The two petitioners claim that the six were not recruited and selected competitively, and that the court should consequently invalidate their appointments.
They also want the court to order Toto and the Public Service Commission to re-hire their support personnel in compliance with the Salaries and Remuneration Commission’s regulations.
