Omtatah’s Petition Challenging Finance Act 2023 To Be Heard On August 28

The petition challenging implementation of the 2023 Finance Act has finally landed at the Apex Court in Kenya with the Supreme Court setting August 28 to give directions on a case filed by Busia Senator Okiya Omtatah challenging Court of Appeal order allowing the implementation of the hotly disputed 2023 Finance Act.

The case, according to Deputy Registrar of the Supreme Court of Kenya Bernard Kasavuli, will be virtually mentioned on August 28 when further orders will be issued.

The Deputy Registrar directed Omtatah to serve the petition of appeal filed in court on August 9 on CS Treasury Prof Njuguna Ndungu and ten others.

Omtatah has stated in his Supreme Court appeal that it will be impossible to restore the damage created by the Finance Act after they successfully explain to the Court how Kenyans were exposed to an unlawful tax regime.

On this basis, he has petitioned the Supreme Court to stay the Court of Appeal’s orders, which set the way for the Finance Act’s implementation.

The Court of Appeal recently overturned a High Court order rendered on July that had temporarily halted implementation of the Finance Act 2023.
