France To Help Kenya Modernize Meteorological Services

Kenya and France are strengthening their long-standing partnership in the fight against climate change.

A recent meeting between H.E. Arnaud Suquet, the French Ambassador to Kenya, and Cabinet Secretary Hon. Soipan Tuya, focused on existing collaborations and exploring new avenues for cooperation.

A key area of focus is the modernization of Kenya’s meteorological services. This upgrade aims to empower the Kenya Meteorological Department (KMD) to deliver timely and accurate weather forecasts and climate data.

This vital information is crucial for ensuring public safety, protecting property, and safeguarding the environment.

The modernization effort is particularly relevant in the face of increasingly extreme weather events and climate shifts. These changes have already caused significant damage and loss of life in Kenya.

Former Pipeline MD Charles Tanui Acquitted in Sh 644 Million Fraud Case

The court acquitted former Kenya Pipeline managing director Charles Tanui and fifteen others of conspiring to defraud the parastatal of Sh644 million.

Anti-corruption Magistrate Felix Kombo stated that the conspiracy charge was not established and that it could not exist without an agreement between the accused.

He stated that there was no evidence in their respective roles that the accused persons had a common intention to defraud the Kenya Pipeline Company.

However, the court determined that some of the accused face additional fraud-related charges.
The case involves a tender from Aero Dispenser Valves Company Limited for the supply of Hydrant Puit Valves, including Under Hydrant Valves, as well as two years of operational spares.

The suspects were charged in December 2018 with wasting public funds on the purchase of 58 Hydrant Pit Valves to replace faulty ones at Jomo Kenyatta International Airport.

Gatundu MP Kagombe Denies Murder Charges; Released On Ksh2 Million Bond

Gatundu MP Gabriel Kagombe has been released on a Sh2 million bond or Sh1 million cash bail with a surety of the same amount.

Kagombe was released after pleading not guilty to murder charges in Machakos’ High Court on Friday.

He appeared before Judge Francis Olel, who had previously ordered that he undergo a mental assessment before entering a plea.

“The court has considered applications by both the prosecution and defence lawyers and hereby orders that the accused person be released on Sh2 million bond or Sh1 million cash bail and surety of a similar amount,” Olel stated.

Olel ordered that the MP appear in court on July 17, 2024.

The MP has been in police cells for about two weeks after being detained for the suspected murder of a bodaboda operator in the Thika sub-county.

The MP was originally arraigned before the same Judge last week, where he was charged with murder in violation of sections 203 and 204 of the Penal Code.

Kangombe was represented by a team of attorneys.

Before Olel issued his decision, the prosecution filed a plea with the court to prevent the accused individual access to Thika Town, where the deceased lived.

In response, the defence counsel argued that their client should be granted reasonable bail terms because he was not a flight risk.

Court orders bank to give records in banking fraud case

A Nairobi Court has directed the Investigating Officer in a case where Stanbic Bank Kenya Limited is being investigated over alleged offence banking fraud to collect investigation documents from the Bank management and appear in Court on June 24, 2024, to confirm receipt of all necessary investigation documents from the Bank.

In the case, Stanbic Bank is being investigated into an offence of fraudulent false accounting Contrary to section 330(b) of the Penal Code by staff of the Bank in the account of Air Afrik Aviation Limited account domiciled at the said Bank.

As a result a case was filed in a Nairobi Court seeking that Stanbic Bank provide the account opening documents and all the relevant information for scrutiny.

Orders compelling the Bank to provide the said documents and information were issued on April 17, 2024,however, the Bank management failed to adhere to the orders.

“An order be and is hereby issued compelling you to nominate authorized person to make and hand over to CI Caroline Omwoyo an Investigator with Banking Fraud Investigation Unit of Directorate of Criminal Investigations, a certificate of production of electronic evidence…” directed Hon. Benard Ochoi.

The Bank would later respond via email on April 29 saying the requested documents were not in their custody.

the proceedings herein relate to the transactions surrounding a credit advice which was issued on 5th February 2016 by the BANK OF SOUTH SUDAN , Bank of South Sudan to STANBIC BANK KENYA LIMITED advising that the Bank’s clearing and settlement account at the BANK OF SOUTH SUDAN had been credited with the sum of USD 7,224,000.00 on account of AIR AFRlK AVIATION LIMITED.

The said Credit Advice was indicated to be in relation to payment due to AIR AFRlK AVIATION LIMITED from the Ministry of Finance and Economic Planning Juba.

On 8th February, 2016, in good faith and in the belief that the said credit advice note represented good value and that actual funds had been remitted by the BANK OF SOUTH SUDAN to the STANBIC BANK KENYA LIMITED offshore USD Nostro account in terms of the said Credit Advice note, STANBIC BANK KENYA LIMITED credited the AIR AFRlK AVIATION LIMITED account with USD 7, 224, 000.00.

At that point, STANBIC BANK KENYA LIMITED had no reason to suspect or believe that the credit advice was not backed by actual funds.

AG Muturi sued by victims of the infamous Nyayo Torture Chambers

The Attorney General, Hon. Justin Muturi together with his counterparts CS Ministry of Interior and National Coordination and CS Ministry of Tourism have been taken to court by the survivors and Victims of the infamous Nyayo Torture Chambers during the Moi era.

In the petition, Bernard Wachira Waheire, Florence Nyaguthi Murage, Joseph Kamonye Manje, Prof. Ngotho Kariuki, Kenya Human Rights Commission and the Law Society of Kenya moved to court on behalf of the Nyayo Torture Chambers Victims in support of findings by the Truth Justice and Reconciliation Commission (TJRC) report that the Nyayo Torture Chambers be converted into a National monument for prosperity.

According to the petitioners, despite various state commitments on the TJRC’s report, the Attorney General and the named Cabinet Secretaries have failed/ neglected to effect the recommendation or actualize their commitments to the detriment of the Petitioners, other victims/ survivors (or their estates) and to the detriment of the nation’s heritage and history.

The petitioners avers that the AG failed to honor their rights, and on the basis of the impugned Legal Notice No. 11. of 1991, refused to convert the Nyayo Torture Chambers into a National Monument.

They informs Court that It is now 13 years since the TJRC Recommendations were made and no action has been taken to effect the recommendation in question despite it having a 1- year timeframe for implementation.

They argue that Without the expedited process of the Court, the Petitioners and any other victim/ survivor of the Nyayo Torture Chambers will continue to be deprived of their rights to reparation and restorative justice; contrary to the United Nations Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law.

 KeNHA warns truck drivers against load breaches

The Kenya National Highway authority (KeNHA) has put on notice owners and drivers of long distance trailers following an increase in cases of overloading.

According to Webuye Weighbridge Operation Manager Seth Ongwaye, three trucks ferrying goods from Kitale to Lodwar were arrested on Wednesday.

Ongwaye noted that the trucks were carrying construction materials which include metals, cement among other items and they were being transported to Lodwar.

“We received information that the trucks were carrying more load than allowed by the law. We intercepted the trucks in coordination with Webuye Weighbridge OCS and found that they were carrying 67, 66, and 81 tonnes instead of the authorized 50 tonnes,” he said.

According to Ongwaye, the trucks had an excess of 17, 16 and 31 tonnes.

He added that overloading was responsible for the destruction of the roads infrastructure where the government has invested billions of shillings.

Ongwaye added that they had embarked on the process of engaging the transporters following rising cases of physical attacks targeting their drivers.

Man charged with selling infringing copies of four figure mathematical tables

A middle-aged man was today arraigned at a Nairobi Court facing charges of selling infringing copies of four figure mathematical tables contrary to Section 38 of the Copyright Act.

According to the prosecution, Samuel Aluta Muyela, on December 30, 2023 was found having in possession for sale infringing copyright works of 1033 Four Figure Mathematical Table 7th Edition whose copyright subsists in the name of Kenya National Examination Council.

He was also charged with being in possession of Printing Machines used for the purpose of making 1128 copies of books titled Four Figure Mathematical Table 7th Edition whose copyright subsists in the name of Kenya National Examination Council.

Appearing before Milimani Law Courts Magistrate Benmark Ekhubi, the accused denied the charges and was released on Ksh 300,000 bond with an alternative cash bail of Ksh 200,000.

Invest In Africa’s Renewable Energy, President Ruto To Global North Investors

President William Ruto has raised concerns over the underfunding of Africa’s renewable energy development.

He said though it was encouraging that 2023 recorded the largest increase in renewable energy capacity, with the addition of about 500 gigawatts globally and new investments worth $600 billion, Africa fared badly.

The President said Africa possesses the highest untapped potential of renewable energy reserves in the world but had only managed 3 gigawatts of the global increase.

“The continent with the world’s greatest potential and the highest demand currently accounts for a paltry 1.6% of the world’s total renewable energy capacity,” he said.

He pointed out that Africa offers huge opportunities for wealthy investors from the Global North in clean energy, offering a win-win outcome for them and the continent.

“African leaders endorsed the Nairobi Declaration, which set the continent’s green power generation target at a five-fold increase from 56GW in 2022 to at least 300 GW by 2030,” he said.

President Ruto made the remarks on Wednesday when he addressed the High-Level Business Segment on Climate Change Response and Transition to Carbon-Free Energy in Seoul, South Korea.

The President said recent floods in Kenya and other parts of the world were a result of climate change and called for joint efforts to mitigate the effects of the phenomenon.

He said Kenya had made tremendous efforts in renewable and clean energy, adding that the country’s power grid is 93% green.

He urged Korea and Korean investors to continue supporting Kenya in clean energy adoption as the country pursues the ambitious plan to enhance the current grid from 3GW to 100GW by 2040.

“The ambition is realistic because Kenya is endowed with abundant potential in every type of renewable energy,” he said.

The President said Africa launched the Africa Green Industrialisation Initiative at COP28 to promote the growth of clean energy manufacturing.

He said this potential puts the continent at an advantage to seize the economic opportunities within the global energy transition.

“This can be achieved by mobilising $1 trillion from public and private finance by 2030,” he said.
