Motorist Moves to Court to Block NTSA’s Instant Traffic Fines System

A Nairobi resident has moved to the High Court seeking to halt the implementation of the National Transport and Safety Authority’s (NTSA) Instant Traffic Fines Management System, arguing that the system is unconstitutional and violates motorists’ right to a fair trial.

In a constitutional petition filed before the Constitutional and Human Rights Division of the High Court in Nairobi, Kennedy Maingi Mutwiri is challenging the legality of the automated traffic enforcement system introduced by NTSA on March 9, 2026.

Mutwiri, who filed the case through Jama Munene Kyalo Advocates LLP, has named the National Transport and Safety Authority (NTSA) as the 1st Respondent and the Attorney General as the 2nd Respondent.

According to court documents, NTSA announced the system through its official X (formerly Twitter) account, stating that it would issue automatic SMS notifications of traffic offences detected through cameras and require motorists to pay fines within seven days.

Failure to pay the fines within the stipulated period would result in additional interest charges and restrictions on NTSA digital services.

However, Mutwiri argues that the system unlawfully allows the Executive arm of government to assume powers that constitutionally belong to the Judiciary.

“The system bypasses the courts and allows the Executive to determine criminal liability,” the petition states.

The petitioner contends that traffic offences are criminal in nature and must therefore be prosecuted before a court of law, where an accused person has the opportunity to defend themselves.

In the petition, Mutwiri argues that the automated system violates Article 47 of the Constitution on the right to fair administrative action and Article 50 on the right to a fair trial, including the presumption of innocence.

He further claims the system undermines the doctrine of separation of powers by allowing NTSA to impose penalties without judicial oversight.

According to the court filings, the system is fully automated and operates without human intervention, raising concerns about the absence of judicial discretion and the possibility of errors.

Mutwiri also argues that the system ignores safeguards provided under Section 117 of the Traffic Act and the Traffic (Minor Offences) Rules, 2016, which govern how minor traffic offences should be handled.

In a Notice of Motion filed alongside the petition, the petitioner is seeking urgent conservatory orders to stop the deployment of the Instant Traffic Fines Management System pending the hearing and determination of the case.

The application asks the court to certify the matter as urgent and issue orders temporarily suspending the system.

Among the final orders sought in the petition are a declaration that the Instant Traffic Fines Management System is unconstitutional, an order of certiorari quashing the NTSA public notice introducing the system, and an order of prohibition barring the Authority from implementing it.

Mutwiri argues that the system condemns motorists “unheard,” contrary to principles of natural justice.

The case is expected to raise significant legal questions about the use of automated enforcement technologies in Kenya’s traffic management system and the extent to which administrative bodies can impose penalties without court involvement.

The matter is yet to be heard.

ODPP Announces 217 Jobs for Clerical Officers, Other Posts

The Office of the Director of Public Prosecutions (ODPP) has announced 217 job openings.

In an advert on Tuesday, March 10, the ODPP invited applications from suitably qualified candidates.

“Pursuant to Section 13 (2) of the Office of the Director of Public Prosecutions Act No. 2 of 2013, the Office shall have power to appoint, control, and supervise its staff in a manner and for such purposes as may be necessary for the promotion of the purpose and the object for which the Office is established.

“Applications are invited from suitably qualified candidates for the under-listed vacancies,” read part of the notice.

The available slots in the ODPP include: Prosecution Counsel (140), Accountant (5), Supply Chain Management Officer (4), Research Officer (5) and Audit Officer (2).

Other vacancies are: Information Communication Technology Officer (5), Public Affairs & Corporate Communication Officer (5), Clerical Officer (25) and Office Assistant III (26).

“Applications should reach the Office on or before 30th March, 2026 by 5.00 p.m. (East African Time),” the notice read.

The office also urged persons with disabilities, intersex individuals, and those from marginalized and minority communities to apply for the positions.

Further, the ODPP said shortlisted candidates will be required to produce originals of their National Identification Card, academic and professional certificates, and transcripts during the interviews.

Cabinet Secretary for Health Hon. Aden Duale has warned health facilities against denying patients treatment under the pretext of system downtime, stating that such actions are unacceptable and violate Kenyans’ constitutional right to healthcare.

The CS directed all facilities contracted under the Social Health Authority (SHA) to continue providing services even when technical challenges occur, warning that any facility found turning away patients risks immediate suspension and possible termination of its contract.

Hon. Duale issued the warning while hosting a delegation from the Kenya Union of Post Primary Education Teachers (KUPPET) led by National Chairperson Omboko Milemba at Afya House, Nairobi, where discussions focused on the Public Officers Medical Cover following the successful transition of 413,577 teachers to SHA.

To strengthen service delivery under the scheme, the CS announced that 425 Senior Officers have been appointed within SHA, with 367 deployed to counties to provide on-the-ground support and assist teachers facing challenges at health facilities.

He further revealed that a dedicated 24-hour focal person has been assigned to handle urgent issues under the Mwalimu Medical Cover, while 47 County Joint Committees have been established to oversee implementation of the Teachers Medical Scheme at the county level.

The committees, chaired by TSC County Directors and comprising SHA managers and union representatives, will meet quarterly to resolve operational issues and improve coordination.

Hon. Duale also announced the activation of a 24-hour toll-free hotline (0800 720 601) and short code (147) to support teachers experiencing emergencies or administrative challenges while accessing care.

In addition, SHA, the Teachers Service Commission (TSC) and KUPPET will roll out a nationwide education campaign to help teachers understand their benefits, access the patient portal, and navigate the scheme.

The CS emphasized that workers’ interests remain safeguarded within the governance structure of SHA, noting that the Central Organization of Trade Unions (COTU) is represented on the Authority’s Board.

The meeting was attended by Principal Secretary for Medical Services Dr. Ouma Oluga, Director-General for Health Dr. Patrick Amoth, SHA CEO Dr. Mercy Mwangangi, Digital Health Agency CEO Eng. Anthony Lenayara, KUPPET Secretary-General Akelo Misori, and TSC Acting CEO Eveleen Mitei, alongside senior Ministry of Health officials.

Gov’t Issues Warning Over Institutions Issuing Unrecognized Certificates

The Technical and Vocational Education and Training Authority (TVETA) has issued a warning over the rising number of training institutions issuing certificates that are not recognized in Kenya.

In a notice on Tuesday, March 10, the authority said it has observed an increase in institutions awarding what it termed as ‘internal certificates’ without the legal mandate to assess or grant nationally recognized qualifications.

TVETA said that no training programme can be offered by an institution without prior approval from the authority. 

It further noted that any academic award or qualification issued by institutions that are not accredited, registered, and licensed under the law will not be recognized in Kenya.

The regulator noted that recognized certificates in the country can only be issued by recognized Qualification Awarding Bodies (QABs) that have been granted legal authority.

According to the authority, a Qualification Awarding Body must be legally established or expressly authorized to conduct assessments and award nationally recognized certificates in compliance with the Kenya National Qualifications Framework.

TVETA also clarified that no private TVET institution has been accredited as a Qualification Awarding Body with the legal mandate to assess and award recognized certificates or qualifications.

“For an academic certificate to be recognized, the institution awarding it must have the legal mandate, the training programme must be approved by the regulator, and the certificate holder must have met the minimum entry requirements for that qualification,” the authority said.

It warned that certificates issued by institutions without the legal mandate are considered internal certificates and are not recognized for employment, career progression, education advancement, licensing, or any official validation in Kenya.

The authority urged members of the public, including trainees, parents, guardians, and employers, to exercise due diligence and remain vigilant against institutions that claim to issue certificates without a clear legal basis.

Prospective students have been encouraged to verify the accreditation status of institutions and awarding bodies before enrolling in training programs or paying any certification-related fees. 

The authority warned that institutions found misrepresenting their legal status or issuing certificates without authorization will face regulatory and legal action.

Safaricom Explains Redacted M-PESA Statements and How to Unblur the Full Version

Safaricom has clarified why M-PESA statements appear with redacted phone numbers and explained the process customers must follow if they want to access a full version.

In a statement on Monday, March 9, Safaricom explained that the redaction of phone numbers is part of its compliance with data protection regulations.

“The phone numbers are redacted due to the data protection policy. Once you request for a statement, an SMS is sent with the password to enable you access the statement,” the company said.

Safaricom further clarified that customers who require the complete, unblurred version of their M-PESA statement must provide an abstract to facilitate the process.

“To access an unblurred statement can only be done from a Safaricom shop and you need to get an abstract to acilitate the process,” the company added.

This comes weeks after David Mokaya, a university student charged in court for publishing false information on President William Ruto, announced that he will sue Safaricom.

In a press statement, Mokaya’s lawyer Danstan Omari accused Safaricom of violating the Data Protection Act by allegedly sharing his client’s location with the police without a court order. 

Omari claimed that the Telco giant also undermined Mokaya’s dignity and right to privacy guaranteed by the Constitution of Kenya.

“This is a violation of the fundamental human right of Mokaya. We shall be moving to the High Court because our client’s constitutional fundamental right was violated.

“We have demanded Ksh200 million. We shall also be asking for legal fees to be provided by Safaricom because this trend must stop,” he revealed.

Omari issued a demand letter to Safaricom, giving it up to Monday to pay Mokaya the money.

The lawyer maintained that officers from the Directorate of Criminal Investigations (DCI) were not allowed to request mobile service providers for the location of Kenyans without a court permit.

Omari further disclosed that he would seek guidance from the court on whether DCI officers were allowed to confiscate suspects’ phones and other gadgets.

“The question of police officers arresting people and the first thing they take is a handset, no law allows police to take possession of phones until a court order is issued,” the lawyer stated.

Omari hinted that he would follow up on other cases where police arrested suspects after mobile service providers disclosed their location.

Ten Players Denied Visas To US For CONCACAF Club Tournament

Ten players with Jamaican side Mount Pleasant have failed to obtain US entry visas for the club’s CONCACAF Champions Cup clash against Los Angeles Galaxy on Wednesday, club officials have confirmed.

Mount Pleasant traveled to Los Angeles on Sunday with an 18-man squad which included five academy players after the team’s roster was decimated by visa problems.

Seven members of the Mount Pleasant squad are Haitian nationals, and the issue brings into sharp focus one of the concerns surrounding this year’s World Cup in the United States, Canada and Mexico.

Haiti is one of 19 countries targeted by US President Donald Trump’s immigration crackdown, with Haitian nationals’ entry to the US suspended under a presidential order issued last June.

Although athletes taking part in major sporting events such as the World Cup and Olympics are exempt from the ban, it was not clear if CONCACAF’s regional club tournament was included amongst those exceptions.

Mount Pleasant’s sporting director Paul Christie said the visa stumbling block would leave Mount Pleasant at a competitive disadvantage as they prepare to face the 2024 MLS Cup champions this week.

“We dont want to just show up for the game, we want to be able to compete, but we are not being given the opportunity to be at our best,” Christie told the Jamaica Observer.

Christie said Mount Pleasant “had not been given the opportunity to field our best starting 11.”

US media reports have said CONCACAF, the regional body for football in North America, Central America and the Caribbean, had been attempting to resolve the issues.

A CONCACAF spokesman did not immediately respond to a request for comment.

It means Mount Pleasant head coach Theodore Whitmore will need to field a makeshift line-up on Wednesday drawn from a team that includes five members of Jamaica’s under-20 team.

Iraq coach calls for World Cup playoff to be re-scheduled

Iraq coach Graham Arnold pleaded with FIFA on Monday to postpone his team’s intercontinental playoff for the World Cup because many of his players and backroom staff are stranded by the growing Iran war.

The Iraqis are due to face either Suriname or Bolivia on March 31 in the Mexican city of Monterrey for a place in the World Cup finals, but with Iraqi airspace closed until April 1, Arnold’s squad is unable to gather or travel.

“If the game goes ahead in Mexico we have the difficulties of getting out of Baghdad,” Arnold, an Australian, told CNN.

“About 60% of my players play in Iraq, all my backroom staff live in Iraq, all my medical staff live in Qatar and we’re having trouble getting Mexican visas at this moment,” he added.

Arnold said he had already been forced to cancel a training camp in the United States.

“That has all been scrapped now, because we can’t get out of Baghdad,” he said.

“FIFA need to obviously make a quick decision on this because it is a bit unfair at this moment, with what we would have to go through.”

He suggested that Suriname and Bolivia could go ahead with their playoff in Monterrey on March 26 and the winner of that game could play Iraq in the United States just before the World Cup, which kicks off on June 11.

“Suriname could always play Bolivia if we can’t get there, and we could always play the winner just before the World Cup and (that) lets us prepare properly and do everything required to be successful,” Arnold said.

“Bolivia and Suriname can play in March, they’ve got no complications with flights or anything, they can get there straight away and we could play the winner

“The winner stays and plays the World Cup and the loser goes home.”

Arnold said the Iraqi football authorities were in close contact with FIFA, but he admitted the situation was taking its toll.

“It’s one step at a time, it’s stressful, (I’ve had) a lot of sleepless nights worrying about getting that planning right,” he said.

An Iraqi source told AFP the national federation had asked for the change.

“Iraq’s request came due to the inability of the delegation to travel from the capital Baghdad,” they said.

“As a result of the closure of airspace and the security risks currently affecting the region,” they added.

Arsenal favourites against Leverkusen in Champions League last 16

Wednesday’s Champions League action sees Paris Saint-Germain and Chelsea meet for the first time since last year’s Club World Cup final, while Real Madrid host Manchester City in the first leg of their last-16 tie as the sides clash in a knockout tie for the fifth season running:

Bayer Leverkusen v Arsenal

Premier League leaders Arsenal, who have never been crowned European champions, remain on track for four trophies this season as they chase their first major silverware since 2020.

Mikel Arteta’s men won all eight matches in the league phase to cruise into the last 16, where success against Leverkusen will set up a tie against Bodo/Glimt or Sporting.

Central defender William Saliba has missed Arsenal’s past two matches with an ankle issue but could be back here.

Currently sixth in the Bundesliga, Leverkusen are still rebuilding after a tumultuous summer in which they lost coach Xabi Alonso and several players including Florian Wirtz, Granit Xhaka and new Gunner Piero Hincapie.

“We’re strong at home. We have a chance there – we can win there,” Alejandro Grimaldo said Saturday.

Remarkably, Leverkusen’s win against Olympiacos in the play-off round was their first victory in a Champions League knockout tie since 2002, when they reached the final before losing to a Zinedine Zidane-inspired Real Madrid.

PSG v Chelsea

PSG are wobbling as the reigning European champions put their title on the line against Chelsea in the first meeting of the teams since the London side won 3-0 in last July’s Club World Cup final.

Luis Enrique’s PSG edged past Ligue 1 rivals Monaco in the play-off round and lost to the principality side on Friday as their lead at the top of the French table from Lens was cut to one point.

The Parisians are a long way off the scintillating form they showed in the second half of last season, with Ballon d’Or winner Ousmane Dembele one of several players struggling for fitness — he is expected to be available here, however.

PSG will also be wary of Chelsea coach Liam Rosenior, who did well against them in his 18 months in charge of Strasbourg.

Estevao Willian and Jamie Gittens are nearing a return for Chelsea but neither were risked in Saturday’s 4-2 win against Wrexham in the FA Cup and it is unclear if they will feature here.

Chelsea reignited their chase for Champions League qualification for next season last midweek as Joao Pedro’s hat-trick inspired a 4-1 win at Aston Villa.

Real Madrid v Man City

Alvaro Arbeloa’s record 15-time European champions stumbled at home against Manchester City in the league phase, back when Xabi Alonso was in charge.

Their prospects of extending their European dominion have not risen much higher since, particularly with a spate of injuries including to key players Kylian Mbappe and Jude Bellingham, who are set to miss the first leg at least. Vinicius Junior, vital in the play-off round against Benfica, carries the keys to Madrid’s potential success here.

The City boss made 10 chances for Saturday’s FA Cup tie against Newcastle United and they still cantered to a 3-1 win.

Erling Haaland did not feature in that game due to an ankle injury and the Norway striker’s availability remains in doubt.

City and Real have met in 15 previous Champions League matches. Madrid knocked City out in the past two seasons, winning 6-3 on aggregate in the play-off round last term and triumphing in a quarter-final penalty shoot-out in 2023/24.

 Bodo/Glimt v Sporting

Bodo/Glimt’s fairytale run continues as they welcome Portuguese champions Sporting to the Aspmyra Stadion, which lies inside the Arctic Circle.

Kjetil Knutsen’s team finished the league phase with wins against Manchester City and Atletico Madrid before beating Inter Milan home and away in the play-offs. That success was all the more remarkable given that the Norwegian league is only just about to come out of its off-season.

Winger Jens Petter Hauge is Glimt’s danger man, having scored six goals in 10 Champions League appearances this season. Sporting, meanwhile, make the journey from Lisbon having finished an impressive seventh in the league phase, in which they notably beat PSG.

Rui Borges’s team are unbeaten in 12 games but were held 2-2 at Braga on Saturday, a result which kept them four points behind domestic league leaders Porto. Their main threat is Colombian striker Luis Suarez, who has 31 goals in all competitions this season.

DCI Arrests Maximilian Motara for Tearing Kenyan Currency Notes and Posting the Videos Online

Detectives from the Banking Fraud Investigations Unit (BFIU), under the Directorate of Criminal Investigations (DCI), arrested Maximilian Motara on March 10, 2026. 

Motara was apprehended for allegedly mutilating Kenyan currency notes—specifically KSh 100 and KSh 200 banknotes—and sharing videos of the act on social media platforms like TikTok. 

Willfully defacing, tearing, cutting, or otherwise mutilating currency notes.

Under Section 367A of the Penal Code and the Central Bank of Kenya Act, it is a criminal offense to damage legal tender.

As of March 10, 2026, he is in custody being processed for arraignment in court.

Offenders convicted under these charges can face up to three months of imprisonment, a fine of up to KES 2,000, or both. 

Authorities have used this case to remind the public that currency notes are the property of the Central Bank of Kenya (CBK) and that individuals only “own” the monetary value, not the physical notes themselves.

Manchester City to face Liverpool in blockbuster FA Cup quarter-final as draw revealed

Manchester City will face Liverpool in a blockbuster FA Cup quarter-final, while quadruple-chasing Arsenal travel to Southampton.

Monday’s draw for the last eight also handed Chelsea a home tie against League One giant-killers Port Vale, who stunned Sunderland with a 1-0 win in the fifth round on Sunday.

West Ham, who beat Brentford 5-3 on penalties after a 2-2 draw on Monday, will host Leeds in the other quarter-final.

But it is City’s latest showdown with rivals Liverpool that is the stand-out tie of the round.

Pep Guardiola’s side have already beaten Liverpool twice this season, winning 3-0 in Manchester in November and earning a 2-1 victory at Anfield in February.

It will be the first FA Cup meeting between the clubs since Liverpool won 3-2 in the semi-finals in 2022.

Liverpool, 3-1 winners at Wolves in the last 16, have won the FA Cup eight times, most recently four years ago.

Seven-time winners City, who beat Newcastle 3-1 in the fifth round, last lifted the trophy in 2023.

Premier League leaders Arsenal advanced to the quarter-finals with a 2-1 win at third tier Mansfield.

Mikel Arteta’s men will head to Championship play-off hopefuls Southampton, who enjoyed a surprise 1-0 win at Fulham in the fifth round.
