Azziad Scandal: Brian Chira To Be Suspended From Kabarak University

Social media influencer Brian Chira has been arraigned in court on charges of defamation and insulting popular TikToker and content creator, Azziad Nasenya.

Brian is currently facing the harsh consequences of his actions with Kabarak University set to suspend him over his irresponsible behaviour. He was also slapped with a high bail and has spent some time behind bars.

Court Reduces 20-Year Jail term For Rape Suspect

Anthony Kuria will now serve 18 years prison sentence after his 20-year sentence was revised by the Appellate Court.

He was sentenced on March 19, 2015, by the trial Magistrate, approximately two and half years after he was arraigned on August 13, 2012.

In his application filed on February 18, 2020, the appellant wanted the court to consider the two years he had served in remand during the trial period.

However, the prosecution opposed the appeal saying the mitigation to the effect that the appellant had spent two years in custody had been considered by the court before sentencing.

Wambui had earlier appealed against both the conviction and sentencing at the High Court on June 27, 2018, but his application was dismissed for lack of merit.

He then proceeded to pursue justice at the Court Appeal on the grounds that his sentencing and conviction violated his rights.

Court of Appeal Justices Agnes Kalekye Murgor, Sankale Ole Kantai and Mwaniki Gachoka noted that the High Court erred in dismissing his first appeal. 

“We note that the appellant is raising an issue of the lawfulness of the sentence, not its severity and therefore this is an issue that deserves our consideration,” they said.

The appellate court noted that in considering mitigation, the trial court must note in the judgment in clear words that the time spent in custody was considered and the sentence imposed takes that period into account.

“The question of whether the time spent in custody was considered should not be left to conjecture, like in this appeal. We note that the first appellate court did not address this issue and just held that the sentence of 20 years imprisonment is legal,”said the judges.

It directed that the appellant’s sentence should be revised to run from the day of arraignment. 

“Consequently, it is our finding and we so hold that this appeal has merit and is allowed to the extent that the sentence that was imposed on 19th March 2015 should run from the date that the appellant was arraigned in court, that is 13th August 2012 as he remained in remand throughout the trial,” concluded the Judges.

Climax Coach Employee In Court Over Theft Of Sh4.6 Million

A middle-aged man in Court for stealing millions of money from Climax Coaches Bus Company located in Nairobi.

Ibrahim Shira Kimani, an employee of Climax Coaches Bus Company found himself on the wrong side of the law after being accused of stealing money in his official capacity as an employee from the said company.

According to the charge sheet, the accused person on diverse dates between November 1 and December 26, 2022 at Machakos County Bus stage within Nairobi, being a servant of Climax Coaches Bus Company stole Ksh 4,616,735.

Appearing before Chief Magistrate Susan Shitubi at Milimani Law Courts, the accused denied the charges and was released on Ksh 1 million bond with an alternative cash bail of Ksh 500,000.

The case will be mentioned on August 10, for pre-trial.

Azimio MPs Agree To Back Kalonzo-Led Team For Ruto-Raila Talks

The opposition Azimio la Umoja One Kenya coalition has reaffirmed its commitment to talks with the ruling Kenya Kwanza administration in order to end the country’s current political impasse.

Azimio made the decision during a Parliamentary Group meeting on Tuesday at the Jaramogi Oginga Odinga Foundation (JOOF) offices, which was presided over by coalition leader Raila Odinga.

The opposition political faction also agreed to back the five-member delegation led by Wiper party leader Kalonzo Musyoka, which was unveiled on Monday to meet with the Kenya Kwanza team.

Eugene Wamalwa (DAP-Kenya party leader), Opiyo Wandayi (National Assembly Minority Leader), Okong’o Omogeni (Nyamira Senator), and Amina Mnyazi (Malindi MP) were also present at the PG meeting as members of the Azimio dialogue team.

Former Murang’a Governor and Usawa Party leader Mwangi Wa Iria, Roots Party leader George Wajackoya, former Agriculture CS Peter Munya, embattled Jubilee Secretary General Jeremiah Kioni, and former Laikipia Governor Nderitu Murithi, as well as at least 65 opposition-allied MPs, attended the Odinga-led PG meeting.

Prior to the negotiations, the Azimio coalition insisted that no party should assert that it can decide which issues can and cannot be raised.

The Azimio delegation intends to raise issues such as the high cost of living, a review of the 2022 General Election, and the bipartisan reorganisation of the IEBC.

Other issues include constitutionally mandated respect for political parties and inclusivity in governmental affairs.

The ball is now on the Kenya Kwanza side to announce its team, which is expected to comprised of two non-parliamentarians, the National Assembly Majority leader and two Members of Parliament.

Musk Threatens To Sue Researchers Who Documented The Rise In Hateful Tweets

X, the social media platform formerly known as Twitter, has threatened to sue a group of independent researchers whose research documented an increase in hate speech on the site since it was purchased last year by Elon Musk.

An attorney representing the social media site wrote to the Center for Countering Digital Hate on July 20 threatening legal action over the nonprofit’s research into hate speech and content moderation. The letter alleged that CCDH’s research publications seem intended “to harm Twitter’s business by driving advertisers away from the platform with incendiary claims.”

Musk is a self-professed free speech absolutist who has welcomed back white supremacists and election deniers to the platform, which he renamed X earlier this month. But the billionaire has at times proven sensitive about critical speech directed at him or his companies.

The center is a nonprofit with offices in the U.S. and United Kingdom. It regularly publishes reports on hate speech, extremism or harmful behavior on social media platforms like X, TikTok or Facebook.

The organization has published several reports critical of Musk’s leadership, detailing an increase in anti-LGBTQ hate speech as well as climate misinformation since his purchase. The letter from X’s attorney cited one specific report from June that found the platform failed to remove neo-Nazi and anti-LGBTQ content from verified users that violated the platform’s rules.

In the letter, attorney Alex Spiro questioned the expertise of the researchers and accused the center of trying to harm X’s reputation. The letter also suggested, without evidence, that the center received funds from some of X’s competitors, even though the center has also published critical reports about TikTok, Facebook and other large platforms.

“CCDH intends to harm Twitter’s business by driving advertisers away from the platform with incendiary claims,” Spiro wrote, using the platform’s former name.

Imran Ahmed, the center’s founder and CEO, told the AP on Monday that his group has never received a similar response from any tech company, despite a history of studying the relationship between social media, hate speech and extremism. He said that typically, the targets of the center’s criticism have responded by defending their work or promising to address any problems that have been identified.

Ahmed said he worried X’s response to the center’s work could have a chilling effect if it frightens other researchers away from studying the platform. He said he also worried that other industries could take note of the strategy.

“This is an unprecedented escalation by a social media company against independent researchers. Musk has just declared open war,” Ahmed told the Associated Press. “If Musk succeeds in silencing us other researchers will be next in line.”

Messages left with Spiro and X were not immediately returned Monday.

It’s not the first time that Musk has fired back at critics. Last year, he suspended the accounts of several journalists who covered his takeover of Twitter. Another user was suspended for using publicly available flight data to track Musk’s private plane; Musk had initially pledged to keep the user on the platform but later changed his mind, citing his personal safety. He also threatened to sue the user before allowing him back on the platform under certain restrictions.

He initially had promised that he would allow any speech on his platform that wasn’t illegal. “I hope that even my worst critics remain on Twitter, because that is what free speech means,” Musk wrote in a tweet last year.

X’s recent threat of a lawsuit prompted concern from U.S. Rep. Adam Schiff, D-Calif., who said the billionaire was trying to use the threat of legal action to punish a nonprofit group trying to hold a powerful social media platform accountable.

“Instead of attacking them, he should be attacking the increasingly disturbing content on Twitter,” Schiff said in a statement.

Klopp Concerned Over Saudi Transfer Window

Liverpool manager Jurgen Klopp on Tuesday urged football authorities to address the late closure of the transfer window in the Saudi Arabia league, fearing it may have a detrimental effect on European clubs.

Speaking in Singapore on the eve of his team’s pre-season friendly against German champions Bayern Munich, Klopp voiced his concern while reacting to the news that former Liverpool striker Sadio Mane is set to leave Bayern to join Saudi side Al Nassr.

Since the start of the year, clubs in the oil-rich Middle Eastern kingdom have spent generously to sign some of the world’s leading players including Cristiano Ronaldo, Karim Benzema and N’Golo Kante.

And Klopp appears concerned that the closure of the Saudi transfer window on 20 September, three weeks after it shuts in Europe, could impact clubs who would be unable to sign suitable replacements

“The influence of Saudi Arabia? We will see. I don’t know. At the moment it looks like they have quite an influence, it is massive,” said the German.

“I think that pretty much the worst thing is that the transfer window in Saudi Arabia is open for three weeks longer. If I am right, I heard something like that. Then, at least in Europe, that’s not helpful. So Uefa and Fifa must find solutions for that.

“But in the end, I don’t know at this moment exactly what will happen. It is already influential, for us, for sure. We will have to learn to deal with it, but that’s what we do,” he added.

“That’s pretty much all I can say about it, time will show.”

Bayern Munich manager Thomas Tuchel was also asked about the rising influence of Saudi football and he likened it to the Chinese Super League where clubs also spent heavily on importing footballing talent in the middle of the last decade.

“I’m just observing the situation, which is a very new situation,” said the Bayern boss.

“It’s maybe a bit similar to the situation when China started their league. It’s kind of a similar gold rush there and we’re experiencing the next league which tries to become more popular, more famous and tries to build a brand by signing a lot of quality players and coaches,” he added.

“It’s a completely new situation and a bit too early for me to have a clear opinion. So I’m an observer, a surprised observer.”
