Businessman Amos Njugi Wachira has moved to court claiming over Ksh.19 million from Nairobi County, Chief Land registrar and three others for allegedly demolishing his building located at Pangani area, Nairobi.
Wachira claims that the property was divided into three blocks, each with 11 residential apartments, four stores, and two ablution blocks, with a total monthly rental income of Ksh.192,000. He claims to be the true and legal owner of the property in question.
“The defendants’ action of evicting the tenants and demolishing the property without due process was illegal and caused him mental pain and misery,” he alleges.
Despite a demand and notice of intent to suit, he claims the defendants have refused, failed, and neglected to settle.
He further requests that the court vacate the certificate of lease granted by the Chief Land Registrar to the first defendants.
He accuses Nairobi City County of conspiring with the Registrar of Lands to provide the bogus certificate of lease to Kachuodho Limited while knowing that he is the bona fide and lawful owner of the land.
When the matter came up for hearing today the court was informed that Kachuodho Limited has not entered appearance in the matter and that the other respondents will not call any witness in the matter.
“This is a land matter –Land cases are very sensitive when you don’t call any witness you throw the court into confusion, “court noted.
