The Employment and Labour Relations Court (ELRC) in Mombasa dismissed a petition that had stalled the recruitment of the Teachers Service Commission (TSC) Chief Executive Officer.

Justice Ocharo Kebira dismissed the application filed by Mombasa resident Thomas Mosomi Oyugi, stating that the petitioner failed to provide sufficient evidence to justify halting the process or demonstrate how the recruitment would adversely affect the public interest.
The court lifted the restrictions previously sought against the appointment, clearing the TSC to proceed with hiring a permanent successor to former CEO Nancy Macharia, whose term expired on June 30, 2025.
The petition, originally filed in May 2025, had challenged the legality of the recruitment criteria—specifically Section 16(2) of the TSC Act—which mandates that candidates must hold a degree in education. The petitioner argued this was discriminatory and excluded qualified professionals from other fields.
Evaleen Mitei has been serving as the acting CEO since Nancy Macharia’s exit, but the commission is now free to finalize a permanent appointment.
