Three police officers accused of robbery with violence will be detained until tomorrow noon when the court is expected to give a ruling on whether to allow the prosecution’s 7 days detention application or to decline.
The three police officers are Sgt Daniel Wambua Mthini, Cpl Eliud Kipkurui Bor and P.C Stanley Gitonga.
The three were arrested on January 9, 2023, by police officers from Nairobi following a complaint from Hassan Abdi Omar of Afro Limited and operating forex, Bureau.
According to court documents, the complainant had withdrawn some cash from Absa Bank Queensway house branch when he was confronted by robbers.
Preliminary investigations revealed that Mr Hassan Abdi had withdrawn Ksh 2 million and while on his way out, he was confronted by the suspects who claimed to be police officers and, in the process, a tussle arose.
The investigating officer told the court that Sgt Daniel Wambua was the custodian of the Armory at Kasarani and they were yet to recover the arms.
He pleaded with the court to grant their 7 days detention order application to pave way for investigations.
The defence counsel on the other hand objected to the move saying that there was no justifiable reason to justify the continued detention of the police officers.
He urged the court to release them on reasonable bail terms as the court awaits the conclusion of the investigations.
“What explanation will the state have to the suspects in an event that at the end of the investigations, nothing tangible comes out of the investigation worth to charge them, they are serving police officers, they are under government pay roll, your honor uphold the rights of the suspects, let justice be our shield and defender” submitted the advocate.
The court directed that it will issue a ruling on the application tomorrow Wednesday, January 11, 2023 at 2pm.
