A High Court has paused a company connected to Raila Odinga’s family from paying Sh7.7 million to another firm that supplied it with oil.
Justice Olga Sewe issued an order of stay pending the hearing and determination of Spectre International’s proposed appeal against a magistrate’s court judgment.
The judge granted the order on the condition that Spectre International deposit the entire decretal sum within 45 days in a joint interest-earning account in the names of the lawyers representing it and Betric Kenya Ltd.
Spectre International had filed an application to have the judgment’s execution stayed.
The firm was anxious that Betric Kenya Ltd would begin implementation of the verdict after an a stay order.
Justice Sewe observed that there appeared to be no indication of resources in the replying affidavit (of Betric Kenya Ltd) other than a general assertion that it was in business.
The judge determined that Spectre International had made a strong enough case to justify the issuance of the orders requested in its application.
