Release Items Not Relevant In Oparanya Probe, Court Orders EACC

The EACC has been asked to hand over any devices or documents that are unrelated to the investigation against former Kakamega Governor Wycliffe Oparanya.

The Ethics and Anti-Corruption Commission had earlier obtained a search warrant and seized several things belonging to Oparanya that were linked to the alleged unlawful purchase of property.

In a court motion, Oparanya claims that sleuths from the Ethics and Anti-Corruption Commission grabbed and took away documents, computers, mobile phones, and Sh2 million in cash.

He claims that the search warrants did not authorize EACC officials to take and transport any papers without establishing a link between those documents and any accused crime.

“The orders did not authorize anyone to seize and carry any mobile phones and computers belonging to other persons who are not parties to the proceedings,” Oparanya said.

He claims that when EACC confiscated cell phones from his children, spouses, and staff, they went beyond the limits of the court orders.

He claims that the officers were on a fishing trip and didn’t know what they required for their investigations, which explains why they cast their net wide in the hope of finding something important.
