On February 3, 2026, former Nairobi Governor Mike Sonko filed an application at the anti-corruption court to compel lawyer Steven Ogola and the Capitol Hill Police Station OCS, Tusca Opondo, to testify in his ongoing Ksh. 20 million graft case.Â
Sonko and his co-accused, businessman Erastus Ombok, are facing charges including abuse of office, money laundering, and conflict of interest related to a 2019 revenue collection tender. They were placed on their defence in February 2025.
The defence, led by lawyer Asa Nyakundi, argues these witnesses hold “material evidence” central to a fair determination of the case: Allegedly possesses three critical documents—two charge sheets and an affidavit of cooperation.
Sonko claims the sequence of these charge sheets (one drafted before the complainant was a co-accused and one after they were dropped) raises questions about the evolution of the case.OCS Tusca Opondo is wanted to produce records and evidence linked to statements Sonko made during the original investigation.
The Office of the Director of Public Prosecutions (ODPP) did not oppose the application to summon the witnesses. However, the prosecution requested that they be furnished with Steve Ogola’s statement before he testifies.
This latest move follows a retrial order after the High Court overturned Sonko’s previous acquittal in December 2024, ruling that the trial magistrate had erred by relying on an outdated charge sheet.
