Three women Elizabeth Aoga, Jackline Njagi and Jackline Owino appeared before the Milimani Law Courts on Tuesday 7, October, 2025, facing charges of conspiracy to commit a felony.
The prosecution alleged that on 5th December 2024, the three conspired to obtain money from Ann Mbugua, who was seeking assistance to retrieve the body of the late James Mbugua from Mbagathi County Hospital for burial at Lang’ata Cemetery in Nairobi County.
The accused were further charged with a second count of giving false information to PC Jesse Ogalo, a police officer in public service.
They are said to have falsely informed the officer that the body of James Mbugua had not been released from the Mbagathi Farewell Home and presented another body in its place information they allegedly knew to be untrue.
According to witness Elisa Achieng, who worked at Lang’ata Cemetery at the time, the body obtained from Mbagathi Farewell Home was buried on 6th December 2024 in a temporary graveyard.
She testified that she registered the burial and was later visited by DCI officers who questioned her on the burial location.
Another witness, Charles, who works in the funeral transport department, confirmed that on the same day, 6th December 2024, he received a call from a woman identified as Waithira inquiring about transport services.
He was then offered a job to transport the body in question to Lang’ata Cemetery for burial using his hearse.
The matter will be ongoing before the Milimani Law Courts.
