The 26th and 27th prosecution witnesses testified in court today in the Sh588 million graft case against former Kiambu Governor Waititu.
His wife Susan Wangari, and other accused persons are also accused.
According to a witness in the case, Waititu has failed to pay the owner of Lake Naivasha Resort the remainder for the purchase price of Delta Hotel, which is located along University Way in Nairobi’s Central Business District.
Waititu still owes Rahab Mwaniki Sh29 million.
The hotel was purchased for Sh380 million.
The Delta Hotel is one of the properties sought in a separate recovery litigation by the Ethics and Anti-Corruption Commission.
The anti-graft agency is suing Waititu and his relatives to retrieve assets and money in accounts totaling Sh1.9 billion.
Mwaniki told Anti-Corruption Magistrate Thomas Nzioki that Sh350 million was paid to Lake Naivasha for the acquisition of Delta Hotel between April and September 2018.
Delta was originally owned by Mwaniki and her daughter Winnie Wangui. She produced paperwork demonstrating the source of the funds used to acquire Delta.
The money trail revealed that her firm, Superiorfone Communications Limited, which was sold to Waititu Delta Hotel, got Sh6 million from a road contractor, who was subsequently granted the Sh588 million irregular bidding to rehabilitate Kiambu roads.
She testified against Waititu, his wife Susan, Testimony Enterprises, its directors and others.
They are facing trial over the irregular award of Sh588,198,328.20 roads tender in Kiambu.
The tender in question was issued on February 12, 2018, and awarded to Testimony Enterprise owned by -Charles Chege and Beth Wangeci after quoting Sh588 million.
The case proceeds in Court tomorrow.
