Shah Eviction: Auctioneer Baraza Released On Bail

Magistrate Gilbert Shikwe ordered Zachary Baraza of Siuma Auctioneer to report to the investigating officers whenever he is summoned.

Auctioneer arrested in connection with the violent eviction of a family in Westlands has been released on Sh200,000 cash bail.

Magistrate Gilbert Shikwe ordered Zachary Baraza of Siuma Auctioneer to report to the investigating officers whenever he is summoned.

The court ruled that the police had failed to successfully demonstrate Zachary’s flight risk.

“I don’t think the investigators need 14 days to take witness statements,” the Magistrate said.

“Even if I accept the DCI’s reasons for needing time to search the land registry, value the land to determine the exact value of the damage, or record witness statements, the question I have to ask myself is, does the respondent need to remain in custody while this is going on?” added the Magistrate.

After the ruling which Zachary terms as a milestone to his justice in the public intrest matter, he told the press that he was simply following a court order presented to him by his client.

Siuma Auctioneers’ Baraza was arrested after the Asian family filed a complaint about him violently evicting them from their Westlands home.

According to the complainant, Niraj Shah, Baraza led 25 people to their family home in the Westlands area and destroyed their property worthy millions.
