‘Riggy G’ is still on the hook for his Ksh. 7.3 billion graft case, as the trial magistrate allowed the case to be withdrawn under Criminal Procedure Court Section 87A.

As explained by Magistrate Victor Wakumile, Gachagua and his co-accused could be re-arrested on the same charges in the future, if the Director of Public Prosecutions (DPP) gathers sufficient evidence.

The Anti-Corruption Court granted the DPP’s request to withdraw Ksh.7.3 billion fraud case against Deputy President Rigathi Gachagua and nine others.

The Magistrate blamed the DPP for charging DP Gachagua and his co-accused without conducting thorough investigations.

“How come the DPP appeared to act and prefer charges based on inconclusive investigations?” “One cannot be led to believe that he acted under duress from his junior, the DCI,” Magistrate Wakumile ruled.

Magistrate Wakumile also stated that the court should make recommendations to improve the criminal justice system in order to avoid similar incidents in the future.
