KEMSA Whistleblower Charged With Extortion

Five men, including the KEMSA Scandal whistleblower, have been charged at a Milimani Court.

The five were charged with fourteen counts of obtaining money by false pretense, attempt to extort, aiding the commission of felony, personation, abduction with intent to confine, forgery, using vehicle registration plates with intent to deceive, and acting in breach of duty under the law.

This was a consolidation of the charges involving an investigative piece dubbed Covid-19 millionaires whistleblower Godwins Otieno Agutu.

The KEMSA scandal whistleblower was charged alongside Alex Mutua Mutuku, Ken Kimanthi Gicovi, Harrison Otieno Ochar, and Hodovia Njoroge Mbugua.

They were before Milimani Principal Magistrate Gilbert Shikwe.

The prosecution argued that the accused obtained Ksh500, 000 from businessman Vijay Patel by personating to be an employee of the Ethics and Anti-corruption Commission and they would assist him in reducing the amount of tax owed by KRA.

This incident was said to have occurred on September 28, 2020.

Godwins, Alex, and Ken further faced charges of abducting Mr. Vijay Patel at Hytech Investment Shop along Kombo Munyiri Road in Nairobi on September 28, 2020.

Godwins was also charged with forging a staff employment card purporting it to be a genuine staff card issued to him by the president’s department of the interior.

He was also said to have forged between September 4 and 24, 2020 a work ticket for an official government motor vehicle registration number GK B 070B.

According to the charge sheet, Godwins, Alex, and Ken, with intent to deceive the complainant presented themselves as employees of EACC using vehicle registration GK B 070B on motor vehicle registration number KCV 788Y.

The court heard that Harisson Otieno and Hodovia Mbugua being employees of KRA acted in breach of their duty imposed under the tax law by visiting Vijay Patel and demanded a bribe of Ksh 2M.

 They will appear again in court on November 18 for fixing of hearing dates.
