The Employment and Labour Relations Court has ordered a petitioner challenging NTSA, to appears in court personally for the evaluation of his affidavit.
The petitioner is demanding that the National Transport and Safety Authority (NTSA) be compelled to recruit qualified candidates for the position of Director General.
Justice Byram Ongaya issued the orders after lawyers for the respondents, NTSA and the Transport Cabinet Secretary, told the court on Tuesday that the applicant, Edwin Oduor, must be cross-examined on his petition.
Mr. Oduor claims in his application that an arrangement allowing NTSA to choose a new Director General when the term of current Director General George Njao expires is detrimental.
As a result, he requests that the court remove the consent, stating that the respondent may re-install Mr. Njao as NTSA Director General.
Early this year, Justice Ongaya delivered a decision allowing the NTSA to recruit anyone as long as they follow the law.
