DPP Drops Corruption Charges Against Former KPLC Boss Ben Chumo

The charges are for the provision of faulty transformers worth Sh400 million.

Noordin Haji, the Director of Public Prosecutions (DPP), withdrew the case against former Kenya Power managing director Ben Chumo and ten others on Wednesday, citing a lack of evidence.

Under Section 87 (a) of the Criminal Procedure Code (CPC), the DPP withdrew the case .
Dr Chumo, his successor Ken Tarus, Beatrice Meso, K.P Mungai, Joshua Mutua, Abubakar Swaleh, Samuel Ndirangu, Stanley Mutwiri, Benson Muriithi, Peter Mwicigi, and John Ombui were all charged in 2018.

The charges are for the provision of faulty transformers worth Sh400 million.

Muwa Trading Company Ltd directors James Njenga Mungai, Grace Wanjira Mungai, and John Mungia were also charged, as was the company alleged to have supplied the faulty transformers. 

However, the case against the company and its directors was dropped in 2021.

The former Kenya Power bosses had denied charges of conspiracy to commit an offence, aiding the commission of a felony, willful failure to comply with procurement laws, conspiracy to defeat justice and fraudulent acquisition of public property.

The defense counsel made an application to have the court order refund of bond and any other security deposited by the accused persons.
