Body By Design Surgeon Freed on Sh1 Million Bond in Botched Surgery Death Case

A cosmetic surgeon accused of killing a woman who visited his clinic for a butt enhancement procedure has been released on a Sh1 million bond with one surety, or an alternative cash bail of Sh500,000.

Dr. Robert Maweu Mutula, along with George Wakaria Njoroge and nurse Lilian Edna Wanjiru Mwariri, all linked to Omnicare Medical Limited (popularly known as Body By Design – BBD), were granted bail by Senior Principal Magistrate Samson Temu at the Kibera Law Courts.

The three have denied charges of manslaughter in the death of Lucy Wambui Kamau, who passed away on October 16, 2024, allegedly following complications from the cosmetic procedure.

While delivering the ruling, Magistrate Temu said bail is a constitutional right and can only be denied if the prosecution proves that the accused are likely to flee if released.

The court granted bail following submissions by veteran lawyer Eric Mutua, who told the court that Dr. Mutula serves as a doctor for Kenya Defence Forces (KDF) personnel and also chairs St John’s Ambulance, a key emergency response organization.

Mutua argued that continued detention of Dr. Mutula would endanger the lives of many who rely on his services.

Meanwhile, the accused have filed a petition at the High Court seeking to block the DPP from prosecuting them for manslaughter, arguing that the matter should instead be handled by the Kenya Medical Practitioners and Dentists Council (KMPDC) as a professional misconduct issue.
