Mombasa Man Sentenced to 20 Years for Defiling 14 Year Old Girl

In her testimony, the girl told the court that she left her parents’ home following a disagreement and went to stay with the accused, whom she described as her boyfriend.

A Mombasa court has sentenced a 21 year old man to 20 years imprisonment after finding him guilty of repeatedly defiling a 14 year old girl in Likoni Sub-County.

Senior Resident Magistrate David Odhiambo, sitting at the Mombasa Law Courts, convicted Al Haji Majaliwa after concluding that the evidence presented met the legal threshold required to prove the offence.

The court found that the prosecution had established the essential elements of the charge, including penetration, the age of the complainant and the identity of the offender.

 The magistrate further ruled that Majaliwa failed to raise a credible defence to counter the evidence presented against him.

According to court records, the offence occurred between January 1 and March 2, 2024, at the Mwananguvuze area, where the accused engaged in sexual acts with the minor while aware that she was underage.

In her testimony, the girl told the court that she left her parents’ home following a disagreement and went to stay with the accused, whom she described as her boyfriend.

She stated that they lived together for several days, during which the sexual encounters took place.

Medical evidence was presented through a clinical officer from Likoni Sub-County Hospital, who testified that examination showed a broken hymen and injuries consistent with sexual penetration.

The minor was also treated for sexually transmitted infections and a urinary tract infection.

Medical documents, including treatment notes, a post-rape care form and a P3 form, were produced as exhibits.

An investigating officer told the court that the accused had been cohabiting with the minor, presenting themselves as husband and wife.

After reviewing the testimonies and exhibits, the court found Majaliwa guilty and imposed the 20 year jail term provided for under the law.
