Court Orders Recount Of Homa Bay Votes

The High Court has ordered a recount of ballots in seven constituencies across Homabay County.

The vote recount and inspection will take place in the seven seats of Kasipul, Rangwe, Suba South, Kabondo Kasipul, Ndhiwa, Suba North, and Homa Bay town.

Justice Roselyne Aburili issued the directive, noting that the petitioner, Evans Kidero, had established a prima facie case to warrant a recount of votes.

“I believe the petitioners (Kidero and his deputy Elijah Odondi) have established a prima facie and substantial foundation to support further investigation and recount.”

“I believe the petitioners have established a solid foundation for scrutinizing Forms 37 A, 37B, and 37C. Similarly, the inspection and verification of the KIEMs kits data utilized in the Homa Bay County Gubernatorial election on August 9, 2022, “Judge Aburili ruled.

The judge, on the other hand, ordered that the recounting be done under the direct supervision of the Deputy Registrar of Homa Bay High Court and in the presence of each of the parties’ four agents, led by IEBC officials.

“A report thereof shall be filed as soon as practicable by the Deputy Registrar, and parties shall be permitted to submit on the same finding at the hearing of the main petition,” Justice Aburili said.

The ruling comes in response to Kidero’s action, which says that the polls in the county were plagued by huge anomalies, voter bribery, swapping of results, voting suppression, and voter manipulation, jeopardizing the county’s integrity.

This, he claims, was made possible by actual brutality, which was presided over in certain cases by security agents and provincial authorities.
