Court Stops Criminal Case Against Controller Of Budget Margaret Nyakang’o

Mombasa Law Courts has finally stopped all the Criminal prosecution against the embattled Controller of Budget Margaret Nyakang’o.

This is after both the Office of the Directorate of Public Prosecutions (ODPP) and the defense informed the trial Magistrate Alex Ithuku at the Mombasa law court that there was a High Court order suspending her prosecution.

The magistrate directed that the matter be mentioned on May 29, 2024.

“In view of the petition the matter is mentioned on 29 May next year,” directed the Magistrate.

The orders were issued last week after a case was filed by West Mugirango MP Stephen Mogaka through lawyer Danstan Omari, challenging Nyakango’s prosecution.

In the court papers, Mogaka argued that the arrest and prosecution of Nyakang’o was a violation of her rights.

Nyakang’o, was arrested in Mombasa on December 5, where the DPP approved multiple criminal charges against her and 10 others.
