Justice Mbaru Monica of the Labour and Employment Court has summoned the Communications Authority of Kenya(CAK) to appear in court on 26th October 2021.
CAK is seeking to fill top management positions of Director, Frequency Spectrum management, and director Competition Management.
CAK is on the spot for changing the recruitment process by introducing possession of a Masters’s degree as a condition for promotion.
Petitioner Muchui Anthony Manyara, in a sworn affidavit, says that the move is unconstitutional, discriminatory, and flies in the face of the 2010 constitution.
Manyara’s affidavit affirms that the move is aimed at ring-fencing key positions at CAK to cronies of interest parties and urged the court to stop the exercise.
In the suit, Manyara says the Masters’ degree requirement cannot be an advantage, as it has no basis in the PSC Act and other related legislations.
Justice Mbaru certified the matter urgent and summoned both parties to appear before her.
