Court terminates case against teacher linked to Senator Kabaka’s death

A court has freed a secondary school teacher who was with Machakos Senator Boniface Mutinda Kabaka in a city hotel the night he collapsed and ended up in intensive care. – By Meshack Makau and John Mutiso.

Ms Esther Nthenya Muli was freed on personal bond on Wednesday, coming after tests on the senator’s blood which showed there was no poison present.

According to the court, the case has been terminated due to lack of evidence after the prosecution said that after analysing a report from the government chemist,they could not find sufficient evidence to hold the suspect.

Nthenya who was arrested on Monday, December 7, 2021 in connection with the incident and was expected to face charges of attempted murder on the senator was freed today without any charges being preferred against her.

This was after the DPP made an application to withdraw the case against her citing that the evidence produced did not place her at the scene.

While discharging her, Milimani law courts Senior Resident Magistrate David Ndungi said that he had considered the application by the DPP to discharge the suspect. She has however been ordered to report to Kilimani Police station every 14 days.
