D-Day: Supreme Court Issues Direction On BBI

The Supreme Court has published instructions in advance of a hearing on the Building Bridges Initiative (BBI) petition, which is scheduled for next week. 

The hearing, which is scheduled for January 18, 19, and 20, will combine the petitions of 80 appellants into one.

Attorneys for the Attorney General and the International Energy Agency will each have 45 minutes to highlight their submissions.

The main Respondents i.e. David Ndii, Jerotich Seii, James Gondi, Wanjiru Gikonyo, Ikal Angelei, Thirdway Alliance, Miruri Waweru and Angela Mwikali, including Phylister Wakesho, who were the main petitioners at the High Court, shall have 45 minutes each to highlight their submissions.

The BBI process, which would have led to a vote on changing some provisions of the constitution, was halted last year by the High Court and Court of Appeal. 

In March 2018, President Uhuru Kenyatta and ODM leader Raila Odinga entered into a truce resulting in the formation of BBI.
