A 47-year-old medical doctor has been charged with assaulting his wife over the custody of their five-year-old daughter.
Vincent Nyaboga Oyiengo was arraigned before Chief magistrate Micheni Wendy with assault causing actual bodily harm contrary to the penal code section 251.
According to the court, the Doctor assaulted his wife, Laura Bonareri Oyiengo, and his son Kiri Osebe Oyiengo occasioning them actual bodily harm.
The Doctor had approached his wife demanding forceful custody of their 5-year-old daughter after the couple initiated a divorce proceeding and the court issued shared custody of the minor.
The altercation is said to have ensued after the said daughter refused to leave with her dad as he had demanded.
The Doctor decided to use force and leave with the daughter who was wailing for help, forcing the mother and the son to intervene.
The Doctor said that the case was a family matter and that he had consulted his divorce lawyer to settle the matter out of court.
The trial magistrate being convinced that indeed the parties were pursuing alternative dispute resolution (ADR), referred the case to ADR and released the accused on a bond of Ksh 20,000.
