EACC Rejects Kananu DG Over Wash Wash Deals

The nomination of Paul Mutunga as Deputy Governor by Nairobi Governor Ann Kananu has been rejected by the Ethics and Anti-Corruption Commission.

The letter arrives just a week after Mutunga was vetted and his name was accepted for the position by the county legislature.

Twalib Mbarak, the EACC’s Chief Executive Officer, stated that the assembly was considering Mutunga’s candidacy without consulting the commission about his integrity qualifications, as required by Chapter 6 of the Constitution.

EACC writes in a letter to County Assembly Speaker Benson Mutura that Mutunga has been charged with corruption charges at the Milimani Anti-Corruption Court, file number ACC8/2019, and that the case is still pending before the court.

“The commission objects to the nomination of Mr Mutunga as the Deputy Governor and advises the Assembly and the Governor to reconsider the nomination,” the statement read.

Mbarak mentioned that Mutunga was facing various accusations, including Unlawful acquisition of public property in violation of Section 45 (1)(a) of the Anti-Corruption and Economic Crimes Act No.3 of 2003, as read under Section 48.

Mutunga is also facing Money laundering in violation of Section 3 and Section 16(1)(a) of the Proceeds of Crime and Anti-Money Laundering Act, 2009, as well as conspiring to conduct a corruption offence in violation of Section 47A(3) and Section 48 of the Anti-Corruption and Economic Crimes Act No.3 of 2003.

He is also accused of dealing with questionable property in violation of Section 47 (2) (a) of the Anti-Corruption and Economic Crimes Act No.3 of 2003, as well as Articles 47 (1) and 48 (1).
