Former Tetu MP Charged For Assault Over Watchmen

Former Tetu MP James Ndung’u Gethenji has been released on Sh200, 000 cash bail.

This ruling was made after the former law maker denied assault charges.

The prosecution also argued that Gethenji was also found to be in possession of a firearm without a valid certificate.

Reportedly, the former legislator at around 11.28 pm on February 5, Gethenji arrived at the gate of Kihingo Village where he lives.

The complainant, Godfrey kirimi Mutua asked the driver to lower the windows of Ndungu’s vehicle so that he could check that they were not surreptitiously smuggling in any 911 guards.

It was alleged that Gethenji was annoyed that Securex had been appointed to replace his 911 security company to provide security at the posh estate.

The defense team led by Counsel Ishmael Nyaribo was seeking for an adjournment of the plea taking citing that the office of the DPP had recalled the file for perusal to withdraw the matter.

This submission was heavily rejected by Anderson Gikunda the prosecution counsel arguing that the matter could not be adjourned again and that the office of the DPP okayed the charges.

In her ruling, Chief magistrate Martha Mutuku ruled that the court could not adjourn the matter.

“The prosecutor presented a letter before court indicating that he has instruction to proceed with plea taking. He has also explained how the accused person moved to the office of the DPP for such review. I take note that the constitution of Kenya provides that the office of the DPP is an independent office. I find that nothing bars this court from taking plea. If the DPP saw directs that the case be withdrawn, I find that this can be done so at any stage,” ruled the magistrate.

Gethenji will appear again in court on August 15 for pretrial.
