A fourth-year University of Nairobi student of Social Science will spend night at Capital hill position waiting his bail and bond determination tomorrow.
Berard Wangila Ojiambo, a student at UoN was arraigned before Senor Principal Magistrate Robinson Ondieki facing charges of preparation to commit a felony.
According to the charge sheet, Ojiambo on September 9, 2024, was arrested along Harry Thuku Road within Nairobi County jointly with others yet to be arrested armed with offensive weapons.
The prosecution alleged that he had a five-litre jerry can with petrol in circumstances that indicated he was too armed to commit arson.
The Prosecution opposed the release of the student on bond or bail pending the hearing and determination of the case.
However, the defence team led by Advocate Danstan Omari objected to the application by the ODPP saying that the student has a Motorbike which he uses to commute to the university and that on material time, his motorbike was out of fuel. Therefore he opted to board another motorbike to purchase the said petrol.
The defence told the court that the student uses his motorbike to engage in the bodaboda business to raise money for his upkeep and school fees due to the challenges in the new University funding model that saw university students languish in poverty due to lack of HELB funds.
They told the court to disregard the allegations by the prosecution and release the student to proceed with his studies.
The matter will be mentioned tomorrow for the bail and bond ruling.
