The Judiciary has come out publicly to defend the conduct of Tononoka Children’s Court magistrate.
This is after Nikesh’s effort in search of his Justice knocked permanent barriers.
According to a statement from the Judiciary, its attention was drawn to a video circulating on social media showing a father complaining about the custody of his three children following a case that was filed in Mombasa.
According to the Judiciary, the case was filed at the Tononoka Children’s Court for custody of the children by some people who alleged to be members of the Hindu Community following the alleged murder of the Children’s mother.
At the time the father of the minors had been arrested as a suspect in the wife’s murder and it was alleged that the children were left in the deplorable care of their paternal parents.
As a result, the Hindu community members requested for interim custody of the children forcing the court to maintain status quo on custody pending hearing of the case.
However, the father was granted visitation rights as the case progressed in the lower court, but he has consistently maintained that ever since the court issued the said order he has never seen his children.
Nikesh was arrested in what seemed to be a conspiracy to cover up alleged murder. However, preliminary investigation confirmed that indeed the woman had taken her life. He was arraigned in court were the investigators sought order to detain him.
However, after DCI officers completed their investigations, they informed the Court that they did not gather sufficient evidence to continue detaining Mr. Nikesh. The court was satisfied that the offence of murder against Mr. Nikesh could not stand in any court of law, hence the court released him unconditionally and opened an inquest case before Kibra Law Courts to determine the cause of death of Vanitah.
In the video, the father continues to lament that his efforts to get his children believed to be in custody of Nyali Sub-County Children’s home has been futile and as a result he is extremely shocked.
He also lives under constant fear after the untimely death of his wife as the community around his residence pose a lot of threats towards him.
