Justice Said Chitembwe has been removed from office by President Uhuru Kenyatta.
Uhuru also appointed a 12-member tribunal to investigate allegations of gross misconduct against the High Court judge in a gazette notice dated May 18.
The decision by the head of state comes after the Judicial Service Commission recommended that the judge be removed.
“The Hon. Justice Said Juma Chitembwe, Judge of the High Court of Kenya, be and is hereby suspended from office with immediate effect,” reads the notice.
According to the JSC, a petition for Justice Chitembwe’s removal from office based on gross misconduct and impropriety presented sufficient grounds for his removal.
The Tribunal to inquire into the matter shall be chaired by Hon. Lady Justice Mumbi Ngugi while others members are Dr. Fred N. Ojiambo SC, Hon. Lady Justice Abida Ali Aroni, Hon. Justice Nzioki wa Makau, Mr. James Ochieng’ Oduol, Lt. Gen. (Rtd.) Jackson W. Ndung’u and Dr. Lydia Nzomo while Kiragu Kimani SC will be the Lead Counsel.
Joseph Gitonga Riungu and Edward Omotii Nyang’au will be assisting counsel while Jasper M. Mbiuki and Sarah Yamo will be Joint Secretaries.
