A court on Thursday established that Kapsaret MP Oscar Sudi is in Eldoret contrary to the reports that he was out of the country.
Sudi failed to appear for the hearing of his fraud case on Wednesday, claiming he had traveled to Turkey to seek medical treatment. It was not made clear to the court what the legislator is ailing from.
But on Thursday the court established that the MP was still within the country.
His defense Lawyers produced unsubstantiated documents in court to convince the court that Sudi is out of the Country.
“These documents still don’t show a specific address where the hospital is located. It is also now clear that your client did not travel. Why did you say he traveled? If he gave you instructions that were not true, tell me and leave it to the court,” said the trial magistrate.
The court allowed the case to adjourn for 30 minutes giving directions to Sudi’s Lawyers to either agree to proceed with the hearing in the accused person’s absence or otherwise the court proceeds to issue a warrant of arrest.
The case thereafter proceeded with the prosecution side staging the former Highway Secondary school principal, Mr. Patrick Maritina as a witness in the academic certificates Forgery case.
Highway Secondary school was dragged in the case after the said Hon. Sudi produced academic certificates in 2013 alluding to be a former student of the school.
The former principal told the court that he received a letter from EACC on September 24,2015 asking him to confirm whether Oscar Sudi was once a student at Highway Secondary school. The principal proceeded to say that after going through the school’s records, he could not trace Oscar Sudi’s details in the records.
The admission register for the years 1995 to 2009 was produced in court as a prosecution exhibit. However, the register could not identify a former student by the name of Oscar Kipchumba Sudi.
Sudi claimed to have obtained a form four certificate from the said school in the year 2006. Going with the register, it is now clear that Oscar Sudi has never been to a secondary school as he alleges.
The case proceeds in court.
