Kanjo Officers To Pay Hawker 427,000 For Plucking His Teeth Out

Three askaris from Nairobi County have negotiated an out-of-court agreement with a hawker whose teeth they extracted last month.

On July 2, 2021, three county officers, Humphrey Muswangi, Hassan Chege, and Dennis Macharia, had an altercation with Anthony Maina in the Nairobi CBD.

The trio allegedly wanted Ksh100 in bribe from the hawker, but he claimed he only had Sh20. They allegedly flogged him with a metal rod while he was still shackled, seriously injuring him.

As a result, Maina lost five teeth and shattered his jaw, compelling him to seek justice.

The hawker, through his lawyer Harrison Musyoka, sent Nairobi County a demand letter demanding that they admit responsibility for beating him within seven days or face legal action.

The lawyer demanded that Nairobi City County issue an urgent written admission of sole and vicarious liability for the irreparable suffering and loss inflicted to him by county officers, after which he would address the City County on the special and general damages for compensation.

The trio begged forgiveness and agreed to pay the claimant Ksh 300,000 in compensation for the loss of five teeth at a cost of 60,000 each, a broken jaw connection at a cost of 56,000, fare/transportation at a cost of 4000, food at a cost of 37800, rent at a cost of 15000, and clinic visits at a cost of 14000, totaling Ksh 427,200.

The compensation will be paid in installments, with the first installment of Sh160,000 due to Mr Maina in cash on August 3, 2021.

A further Ksh50,000 was to be sent to the dealer via mobile money, with the final Ksh217,200 tranche due on or before August 17, 2021.
