Man Handed 60-Year Jail Term For Defiling Two-Year-Old Child

A Kibera court has sentenced a man to 60 years in jail after being convicted of defiling a minor aged 2 years.

Rodgers Alianda Atseka was sentenced by Kibera Senior Principal Magistrate Christine Njagi after the Court ruled that the prosecution had proved their case against him.

While sentencing the accused person, the magistrate noted that the offence was barbaric and a serious injustice to the rights of the minor.

“To safeguard the society and send a warning to other offenders of such behaviour, the accused person is hereby sentenced to 60 years in jail. He has a right of appeal within 14 days,” the magistrate noted.

“The offence of defilement was well proved that all the evidence points that the accused person committed the offence. The prosecution case was proved and the accused person’s defence cannot be relied on,” she added.

The accused person had denied before the court that he committed the offence stating that the case had been fabricated against him.

According to the charge sheet, the accused person had been charged with the offence of defilement Contrary to Section 8(1) as read with Section 8(2) of the Sexual Offences Act No. 3 of 2006.

He had been charged with another count of Committing an Indecent Act with a Child, contrary to Section 11(1) of the Sexual Offences Act No. 3 of 206

The court heard that the accused person lured the mirror from where she was playing with her friends under the pretext of going to buy candy for her before defiling her.
