Petition To Postpone Election Thrown Out By Court

The High Court has declined the petition to postpone the August 9 General Election, stating that the timetable is constitutional.

Justice Anthony Mrima stated that a general election should be held concurrently and that this is not negotiable.

“Constitutionally, August 9 is the second Tuesday of the fifth year’s general election. On the election day, the Constitution is unambiguous. The Constitution cannot be subverted, ” stated the Judge. 

The law suit was initiated by former Senator Paul Njoroge. In the suit, he claimed that when the date for the next General Election was announced, the commission was not properly constituted because the commission lacked a CEO at the time.

He also claimed that President Uhuru Kenyatta’s and DP William Ruto’s terms would expire in November because the previous elections were held on October 26, 2017.

However, the Judge could not agree with the petitioner on the basis that the Constitution demands that a General Election be held every fifth year on the second Tuesday of August.

The Court has therefore given a Lee way for the August 9,general elections will proceed as earlier on planned.

Mwangi Wa Iria: I Will Be A CS In Raila Government

Mwangi wa Iria, the governor of Murang’a, claims that Raila Odinga recently made a ministerial pledge to him. 

Speaking on Friday, August 5, Wa Iria encouraged the people of Murang’a to support Raila in order for the promise to be kept.

“If you don’t elect Baba, I wont be a minister. I am done and I will go with all that I have done for you and the others I am planning to do.

“Why would you terrorize me Murang’a people?” He posed.

At the same time, the two-term governor said Raila also promised to revive and fund milk processing plants in Murang’a. 

“I am asking the milk farmers in Muranga and Central Kenya to listen to me and support me.

“When we had a sitting with Raila, we agreed our milk company will be getting funding like KCC.

“Even when he was Muranga he echoed that, so that we can make butter and other products and also grow,” he stated.

He reiterated that for all the promises to come to fruition, Mount Kenya should vote for Raila to the man.

“For these things, I must have a position in the government for me to deliver.

“Raila has promised me a position. I will be a minister in Raila Odinga’s government. Please on 9th vote for me by voting Raila,” he added.

Wa Iria shelved his presidential bid last month and joined Raila’s Azimio camp.

Be Good Ambassadors Of Kenya — Uhuru Tells Seafarers

President Uhuru Kenyatta has challenged 350 newly hired seafarers to be good brand ambassadors of the Kenyan nation saying their conduct will determine the demand for Kenyan maritime professionals by international shipping lines.

“To the new recruits that we are commissioning today, let me remind you that you sail out as our ambassadors.  How many more Kenyans are recruited in the future will, to a large extent, depend on the image of Kenya you project abroad,” the President said. 

The Head of State spoke on Wednesday at the Kenya Maritime Academy in Mombasa County during the flagging off ceremony of 350 young Kenyan seafarers recently recruited by Atlanta based Celebrity Cruises.

The President recalled with nostalgia the good old days when Kenya used to be the leading regional source market for seafarers, serving major shipping lines across the world. 

“I remember the many Kenyans who used to come here with good money after serving abroad. We wish you the very best as you embark on your new career. 

“We recall that in the early 70s we used to have more than 10,000 seafarers as a country, and these were men and women who actually breathed life not only to Mombasa but to many other towns in our country.

“But because of mismanagement of the sector this was reduced to almost nothing,” President Kenyatta said as he thanked Celebrity Cruises and other shipping for continuing to offer young Kenyan seafarers employment opportunities on their vessels.

“I want to begin, in particular, to thank the Mediterranean Shipping Company MSC. Because they came in as our very first partners and as General (Rtd) Mwathethe said, you took some of our young men and women, both of whom I had the pleasure of launching, who have proven to be very successful,” President Kenyatta said.

He thanked Kenya’s blue economy office led by General (Rtd) Samson Mwathethe and State House Deputy Chief of Staff responsible for policy and strategy Mrs Ruth Kagia for steering the restoration of the seafaring profession.

“I want to recognize the works that have been done by both the ministry in charge of maritime and a special vote of thanks to Retired General Samson Mwathethe and Madam Ruth Kagia who for the last five years have really been struggling to see how we can restore some of that lost glory,” the President said.

Earlier, President Kenyatta, who was on a day-long working tour of Mombasa County commissioned several infrastructural projects among them the new Ksh 4.5 billion Makupa Bridge, the offshore Kipevu Oil Terminal and the Liwatoni Fisheries Complex.

Speaking to wananchi at Makupa Bridge, President Kenyatta said the construction of Makupa Bridge in a record 17 months was a testimony of his successful 10-year tenure and rubbished his doubters as peddlers of falsehoods.

“Some leaders have been moving around the country saying after the handshake we achieved nothing. But this project is proof that we have done a lot. We have been able to do this because of the peace and stability we have experienced in the last few years, especially because of the handshake,” the President said.

He said the completion of Makupa Bridge and the opening up of the 1929 causeway had restored Mombasa’s enviable status as a true island.

Mombasa leaders led by Governor Ali Hassan Joho thanked the President for the projects successfully implemented by President Kenyatta’s administration, and assured of the county’s full backing of Azimio La Umoja’s presidential candidate Raila Odinga in Tuesday’s poll.

Cabinet Secretaries James Macharia (Infrastructure) and Monica Juma (Energy) accompanied the President on the day-long working tour.

Magoha Set To Exit With Uhuru Kenyatta

Prof. George Magoha, the Education Cabinet Secretary, made his retirement announcement yesterday. President Uhuru Kenyatta’s term will come to a close next month. 

In response to recent rumors that he had requested to be kept on by the new administration in order to oversee the complete implementation of the Competency-Based Curriculum (CBC), Magoha was adamant that he was not searching for employment with the new administration.

 “First of all, let me disabuse the minds of citizens, I am not looking for another job, what I have is enough, I have a target to make. So I will work even on Monday and that is on the eve of elections and by that time, our target will have got higher,” said the CS.

“After election results are announced, I am serving someone called President Uhuru Kenyatta and I will leave with him. When he is still there as the President, you will see me out working and when he stops, I stop,” Magoha explained.

The CS made the remarks after inspecting CBC classrooms at Nairobi School.

He said that if he will have completed the target to build classrooms by the time of exiting the office, it will be a welcome move.

“If I will have completed the target before then, well and good… and the way we are going, don’t you see I will complete it very early? For example, if someone goes to court before they finish I will have completed and I will also rest like everybody else.

However, before then if it is within the law, it is proper and just, a good sacrifice for someone who has been blessed by God with everything to give back to the children, don’t you think so?” Magoha posed.

Tuneless Bangladeshi social media star grilled by police

An out-of-tune Bangladeshi singer with a huge internet following was hauled in by police at dawn and told to cease his painful renditions of classical songs, sparking a furore on social media.

“Hero” Alom, as he styles himself, has amassed nearly two million Facebook followers and almost 1.5 million on YouTube with his unique crooning style and arresting, raunchy videos.

One of his numbers, Arabian Song, in which he appears in traditional Arab clothing on a sand dune with camels superimposed in the background, has garnered 17 million views.

But he has also drawn critics’ scorn, particularly for versions of classic songs of two beloved national treasures — Nobel laureate Rabindranath Tagore and Bangladesh’s national poet Kazi Nazrul Islam.

On Wednesday Alom told AFP that he was “mentally tortured” last week by police who told him to stop performing classical songs, that he was too ugly to be a singer, and to sign an “apology” bond.

“The police picked me up at 6am and kept me there for eight hours. They asked me why I sing Rabindra and Nazrul songs,” he said.

Dhaka’s chief detective Harun ur Rashid told reporters that Alom had apologised for singing the cherished songs and for wearing police uniforms without permission in his videos.

“We received many complaints against him,” Harun said.

“(He) totally changed the (traditional) style (of singing)… He assured us that he won’t repeat this,” Harun added.

Farook Hossain, deputy police commissioner of Dhaka, rejected claims by Alom, 37, that he had also been pressed to change his name.

“He is making these comments just to go viral in social media,” he told AFP.

Following his ordeal, Alam released a new video depicting himself behind bars in a prison outfit, warbling mournfully that he is about to be hanged.

Alom’s treatment triggered outrage on social media, with commentators and activists calling it an attack on individual rights — even if his singing grates.

“I am not a fan of your songs or your acting. But if there is an attempt to muzzle your voice, I stand up against it,” journalist Aditya Arafat posted.

“Don’t be broken. You are a hero. No matter what others say, you are a real hero,” Sanjida Khatun Rakhi wrote on Alom’s Facebook page.

Alom says he has acted in several films and also participated in Bangladesh’s parliamentary election in 2018 as an independent candidate — garnering 638 votes.

He told AFP at his Dhaka studio that he started using the moniker “Hero” after becoming popular in his home district of Bogra, 150 kilometres (95 miles) north of Dhaka.

“I felt like I am a hero. So I took the name Hero Alom. I won’t drop this name no matter what,” he said.

“At present, it seems you can’t even sing with freedom in Bangladesh.”

13 Dead As Fire Burns Down Nightclub

At least 13 people have been killed and 35 injured when a fire broke out at a nightclub in Thailand’s eastern Chonburi province.

The cause of the fire early on Friday is still unknown and all victims so far have been identified as Thai nationals, police said.

A separate statement from the Chonburi emergency service described 14 of the injuries as severe.

The fire at the Mountain B nightclub, about 180 kilometres southeast of the capital Bangkok, started at about 1am local time, Wuttipong Somjai, a superintendent at a local police station, told Reuters by phone.

Local TV footage showed people fleeing the fire and emergency workers putting out flames and looking through the burnt-out premises, with shoes and bottles strewn across the ground.

A witness who went by the name Nana told local TV she was with five friends when the fire broke out at the venue.

“I saw flames above the stage, on the right side. I think it was about the same time at the singer on stage saw it too and he shouted ‘fire!’ and threw the mic at it,” she told broadcaster PPTV. “I saw a lot of the pub’s bouncers covered in fire inside.”

The incident comes 13 years after pyrotechnics started a blaze at a New Year’s party at the crowded Santika night club in Bangkok, killing 66 people.

Investigations into that fire found several key breaches at the club, official corruption and revealed lax attitudes towards safety at entertainment venues at the time.

Prime Minister Prayuth Chan-ocha on Friday assured victims’ families they would receive help from authorities and urged entertainment venues nationwide to ensure they have proper emergency exits and safety measures in place.

DPP Asks EACC To Probe Transfer of voters

Noordin Haji, Director of Public Prosecutions (DPP), has directed the Ethics and Anti-Corruption Commission (EACC) to investigate recent allegations of irregular and illegal voter transfers in parts of Wajir and Garissa counties.

In a letter dated August 4, DPP Haji referred to a report on the alleged incidents from the Independent Electoral and Boundaries Commission (IEBC) CEO Marjan Hussein.

Five commission officials, according to Haji, transferred the voters to Eldas Constituency in Wajir County and Balambala Constituency in Garissa County.

The officials have since been identified as; Adan Salah (former ICT Officer for Wajir now in Garissa), Issack Muhumed (from Returning Officer for Eldas now in Ijara), Abdullahi Musa Mohammed (from RO for Balambala now in Wajir North).

The others were Mohammed Maow Abdi (former Deputy RO for Balambala) and Ali Noor Hussein (RO for Balambala Constituency).

“The alleged registration and transfers of voters to Eldas Constituency in Wajir County and the Balambala Constituency in Garissa County by the aforementioned IEBC staff is contrary to Sections 3 and 6 of the Election Offences Act, 2016. 1,” the DPP said in a letter to EACC.

“Pursuant to Section 5(2) (b) of ODPP Act and Section 21 of the Elections Offences Act, I hereby request you to institute comprehensive investigations into the said allegations and thereafter submit the resultant investigation file for perusal and further directions.”

The letter comes just weeks after Deputy President William Ruto claimed that voters were transferred from his strongholds, a move he called a ruse to rig the upcoming elections.

DSTV Increases Subscriptions Costs

DSTV customers will from September 1, 2022 have to cough up more cash to access the subscription TV service.

This comes after Multichoice said on Tuesday that it would be raising subscription prices for all bundles by September 2022. MultiChoice is the owner of the direct broadcast satellite service known as DStv (Digital Satellite Television).

A comparable pricing adjustment will take place on September 1, 2022, according to DSTV Uganda. The packages include Access, Family, Compact, and Premium.

After subscribing to one of the existing packages, users can select additional packages at an additional cost. After a pricing review, premium monthly rates would rise to Sh8,900 in September from Sh7,900 in 2021, where they were at the time.

Even though it was up against fierce competition from online streaming websites and platforms last year, Multichoice increased its subscription rate. Inflation, which had an impact on the company’s operations, was blamed for the decision.

Club Bouncers Arrested Over The Death Of A Policeman

Two people have been arrested in connection with the death of Moses Oyugi, a Kisumu-based police officer who was pushed down the stairs of a nightclub in Ngong, Kajiado County, on July 30, 2022.

Jackline Nduta (34), and Jessey Levi Luyali (22), both bouncers at the Grand Mirage Lounge where the incident occurred, are being held in police custody pending their arraignment in court on Friday, where they will face murder charges.

According to police, the pair was apprehended after homicide detectives from the Directorate of Criminal Investigations (DCI), who took over the investigation from Ngong police, positively identified them from surveillance footage of the incident.

The homicide team was called in amid allegations of a cover-up by local police and the nightclub’s management.

In the CCTV footage, Oyugi appears to be approached by a man in a white t-shirt before a fight breaks out, attracting the attention of the club’s security.

A minute later, a second video from the club’s entrance shows security men pushing Oyugi down the stairs, where he landed head first.

The man who has since been arrested as the main suspect is then pushed as well. Fortunately, he does not fall down the stairs.

One of the bouncers walks down to find Oyugi, but he is unresponsive. The deceased was rushed to Nairobi West Hospital, where he died on August 2 from his injuries.

Chief Government Pathologist Johansen Oduor conducted an autopsy on the 38-year-old father of two and discovered that Oyugi died as a result of a blood clot in the brain caused by blunt force trauma consistent with a fall down the stairs.

Ojaamong Graft Scandal: Court Gives More Time To Probe Documents

The anti-corruption court has given the prosecution team additional time to question a cache of defense documents supplied by Busia Governor Sospeter Ojaamong in his Sh8 million graft case.

Godfrey Odongo, Ojaamong’s third witness, provided 30 documents in a bid to clear the governor of any misconduct in the solid waste management feasibility study case.

Among the documents are the Busia county supplementary appropriations law, the supplementary budget for the fiscal year 2013-14, budget projections, and the budget and appropriations committee report.

The prosecution informed anti-corruption magistrate Douglas Ogoti that they will need time to review the records and then file an application on the materials to which they will object.

“Given the nature of this case, I would not be in a position to analyze the same for the time being,” the court heard.

Odongo testified in court that there was no budgetary allocation for the feasibility study in the 2013-14 fiscal year, but that a supplementary budget was eventually given.

Snother eyewitness Jairus Oriko, the feasibility study’s supervisor, insisted that the organization given the Sh8 million tender completed the work.

Oriko drafted the terms of reference, which outlined what Madam R Enterprises (the corporation) will perform for Busia County.

He denied any ties to the governor, claiming that he was appointed as supervisor because he was the senior officer in the department in charge of the research.

The case was later scheduled for a hearing on August 23.
