Constitutional moment call “fake”- CJ Mutunga

The constitutional moment pronounced by President Kenyatta on Mashujaa day is fake, former CJ Willy Mutunga has said.
Mutunga said that moment was fertile in 2010 and not now, unless the President is admitting he failed to implement the promulgated constitution.


He said Uhuru should have subjected the BBI document to scrutiny by Kenyans before launching it. “There is no need to dump the document to the door step of Kenyan people. Its purpose is to entrench political power for the big 5 tribes”, Mutunga said.
He said Kenya’s big five tribes are the cause of political instability and said it is time for a moderate politician such as Mukhisa Kituyi, Kivutha Kibwana or Aukot to rule Kenya.


Mutunga said the BBI report is geared towards entrenching the interests of political barons from these tribes and not the hustlers who toil day and night for a living. At the same time, Mutunga says DP William Ruto is part of the barons, and is nowhere near the hustler status he claims.

The five big tribes in Kenya are the Kikuyu, Kalenjin, Luhya, Luo and the Kamba. DP Ruto is the prefect of the Kalenjin nation, Raila Odinga (Luo and parts of Luhia land), Kalonzo Musyika(Kamba) and President Kenyatta(GEMA). Speaking during a live Citizen TV show, Mutunga said there has never been enmity between ethnic groups in Kenya, but a situation is manipulated every 5 years to perpetuate political survival of the political barons.


He claimed the big five will coin other alliances by 2012, for purposes of power sharing. Political and tribal barons perpetuate impunity through their ethnic groups, thereby threatening stability, authoring political violence to hold and control power.
This, Mutunga said is the reason why Kenya cannot be ruled by a moderate politician such as Dr. Mukhisa Kituyi, Kivutha Kibwana and others.


The barons as currently constituted are manifested through the big five tribes- Kikuyus, Kalenjins, Luhias, Luos and Kambas.
“These are political barons, they are holding Kenya at ransom. They control 70 per cent of the votes”, Mutunga said.
The former CJ said these tribes will decide who rules Kenya, its a tyranny of tribes. The real liberation for Kenya will arrive when voters rebel against the big five, Mutunga said. “Forget the deep state. Uhuru can access intelligence from other spy agencies as the head of state, his horizon is very expansive”, Mutunga said.

The former CJ said Dedan Kimathi deserves a decent symbolic burial. It has happened in other scenarios when people disappear.
Historical injustices such as the issue of land need to be dealt with. There is need to exorcise the ghosts Kikuyus bore the brunt of colonial atrocities, there is need to discuss and exorcise these past demons.


He said Kenya cannot evolve to a country of ideals if the five political barons continue to intimidate Kenyans. Kenyan politics is anchored on tribalism, religion and myopism. There is no concrete political leadership space in Kenya. The five barons control politics. That is why Dr. Mukhisa Kituyi and Kivutha Kibwana cannot be “The barons narrative has evolved since 1957. This works. But there is hope, if Kenyans resist. We have made progress”, he said.


Mutunga said the constitution dispensation is the third liberation. Implementation is forth. He said Uhuru’s assertion of a constitutional moment is an acceptance of failure to implement the 2010 constitution. Professor Kibwana and Mukhisa Kituyi cannot be elected President of Kenya. The five political barons career allow them. These are Uhuru, DP Ruto, Raila Odinga, Kalonzo Musyoka and Musalia Mudavadi, Mutunga says he lives in a flat, pays service charge, attends estate Court meetings and hustles with live at a gated community.


Mutunga, an unapologetic Kamba traditionalist, hails from Nzambani Location, Kitui County. He is highly regarded in Kitui despite his controversial demeanor and sometimes hypocritical tendencies. ” Why should prophet Owuor be treated better than Jesus Christ. We have a problem here”, he said.


He said there are no hustlers in leadership in Kenya. Boda Boda riders can never ascend to presidential power. This is intra elite battles. Kenya is an outpost of foreign nations. It’s political psyche is decided elsewhere. ” Kenya has evolved positively. 1970 was hell. We have lost time but we are not empty handed. Devolution has worked”, he said.

He said he will never seek political office. “I have been a President. I cant accept to be an appendage of the 5 political barons in Kenya”, he said.

National debate should have preceded the launch of the the BBI report. A third force, devoid if the 5 tyrants is possible Musalia, Kibwana, Aukot can swing a surprise. Kibaki said politicians in Kenya are dishonest. Mutunga says Kibaki was Moi project in 1992, Uhuru was Moi project in 2002, Kalonzo was Kibaki project in 2007 and Moi was Kibaki project in 2007.

Pope suggest creating a civil union law for same sex marriage

What we have to create is a civil union law. That way they are legally covered,” the Pope said. The film also explores the Pope’s work and views in other issues, including climate change, migration and economic equality, according to the film’s website. It is set to premiere in North America on Sunday during the SCAD Savannah Film Festival.


Francis has suggested in past interviews that he is not against civil unions, but this is the first time as Pope that he has directly come out in favor of them.


As Archbishop of Buenos Aires, Francis advocated for same-sex civil unions as an alternative when Argentina was discussing whether to legalize same-sex marriage. Francis’ comments differ from his predecessor, Benedict XVI, who made the news when he labeled homosexuality “an intrinsic moral evil.”


Jesuit Father James Martin, who has advocated for the church to welcome LGBTQ people, said bishops from many countries, including some in the United States and Poland, who are “violently against” civil unions will have to rethink their positions.
“He’s creating a new space for LGBT people … He’s saying it on the record and he’s being very clear. It’s not simply that he’s tolerating it — he’s supporting it,” Martin told CNN’s Christine Amanpour on Wednesday.


In the US, Bishop Thomas Tobin of Providence, Rhode Island, asked for more clarification, saying the Francis’ comments contradict the church’s teachings on same-sex unions.


“The Church cannot support the acceptance of objectively immoral relationships,” Thomas said in a statement. “Individuals with same-sex attraction are beloved children of God and must have their personal human rights and civil rights recognized and protected by law. However, the legalization of their civil unions, which seek to simulate holy matrimony, is not admissible.”

Covid-19 vaccine trials won’t tell us if the shots save lives

The most advanced trials for coronavirus vaccines cannot tell researchers if the shots will save lives, or even if they’ll prevent serious disease, a drug development expert pointed out Wednesday.

The ongoing trials are only designed to show if the vaccines prevent infection — and most infections are mild infections, Peter Doshi, an associate editor at the BMJ medical journal and a drug development specialist at the University of Maryland’s school of pharmacy, said.

“Hospital admissions and deaths from Covid-19 are simply too uncommon in the population being studied for an effective vaccine to demonstrate statistically significant differences in a trial of 30,000 people.

The same is true of its ability to save lives or prevent transmission: the trials are not designed to find out. “

But that doesn’t mean the vaccines saved people from serious disease or death, Doshi argued.

Doshi said they should consider asking the companies to reconfigure their trials to include data on preventing severe illness and death.

“People expect that the most severe part of the Covid iceberg — the ICU admissions and hospitalizations and deaths — that’s what a vaccine would put an end to,” he said.

It’s possible to keep these current trials going and add onto them so that they will, eventually, answer the question of whether Covid vaccines save lives and prevent severe disease.

BBI is meant to unite the country, President Kenyatta tells residents of Kisii and Nyamira Counties

President Uhuru Kenyatta has advised residents of Kisii and Nyamira Counties to read and understand the Building Bridges Initiative (BBI) report released today to avoid being misled by selfish politicians.

He said the objective of BBI is to build a cohesive, equal and progressive nation adding that the process is open to all Kenyans.

The Head of State spoke at different venues today in Kisii and Nyamira Counties where he launched several development projects.

Among the projects unveiled by the President are the Central Bank of KENYA (CBK) Kisii Centre (Kisii County) and the 45-Kilometer Chebilat-Ikonge-Chabera-Nyamusi Road in Nyamira County.

The President also met and addressed boda boda operators in Kisii town.

Speaking to wananchi after launching the CBK currency centre, the President said his agenda is to leave a legacy of a united, peaceful and cohesive nation where citizen rights are guaranteed and protected.

“We don’t want a nation divided along tribal or religious grounds. We want to solve challenges, which have been bedevilling us as a country.

“We want all Kenyans to have access to all what they need to live better lives. And that is what is contained in the BBI,” the President said.

The Head of State said his intentions are for the greater good of the country and that he has no intention of staying in office beyond his constitutional term limit.

“I respect the rule of law and there’s no way, I will extend my term in office. All that I am championing for is for Kenyans to live harmoniously and peaceful without worrying of a cycle of election violence that will disrupt their lives,” the President said.

“We want a nation where every citizen can plan, work and get what they require for their livelihoods. Kenya is a great nation and all of us are entitled to benefit from it. It doesn’t matter whether you are rich or poor, what matters is whether you can have what you want for life,” he added.

President Kenyatta pointed out that the opening of the CBK facility in the town will benefit locals by lowering cost of transacting in foreign currencies.

“I know most of the residents here have relatives working and living abroad and sometimes they send money to buy property here at home. With the opening of this branch, you will now be able to easily access services at a lower cost,” the President said.

At the meeting with boda boda operators, the Head of State said he has always championed for the empowerment of the youth and announced Government plans to help the transporters set up saving societies.

“Plans are underway to ensure all young people operating bodabodas are able to form groups where they can bring their resources together with the aim of improving their livelihoods,” the President said.

Opposition leader Raila Odinga, who also addressed the operators, said the BBI process will provide a solution to most of the challenges facing Kenyans.

The former premier advised Kenyans to read and understand the newly realised BBI report to avoid being misled by those out to maintain the status quo.

In Nyamira County where he commissioned the 45km Chebilat-Ikonge-Chabera-Nyamusi Road, the President directed Infrastructure CS James Macharia to ensure that streets within Ikonge and neighbouring towns were tarmacked.

The Head of State asked local leaders to identify other roads in Kisii and Nyamira Counties for upgrading.

He announced Government plans to equip Ikerepayo Hospital and offered to donate a bus to Ikonge Boys Secondary School.

Mr Odinga who also spoke at road commissioning urged area residents to familiarize themselves with the BBI Report saying the process will among other challenges fix historical injustices and tribalism.

Ozil ‘deeply disappointed’ after Premier League squad omission

Arsenal midfielder Mesut Ozil says he is “deeply disappointed” after being left out of the Gunners’ 25-man Premier League squad.

Ozil, 32, who joined Arsenal for a then club record £42.4m in 2013, has not played for the club since 7 March.

The German, who had also been omitted from the Europa League squad, can now only play for Arsenal Under-23s until his deal expires in summer 2021.

In a message to Arsenal fans, he said “loyalty is hard to come by nowadays”.

“I’m really deeply disappointed by the fact that I have not been registered for the Premier League season for the time being,” Ozil wrote on social media.

“Upon signing my new contract in 2018, I pledged my loyalty and allegiance to the club that I love, Arsenal, and it saddens me that this has not been reciprocated.

“I’ve always tried to remain positive from week to week that there’s maybe a chance to get back in the squad soon again. That’s why I kept silent so far.

EU tells Britain to make up its mind as Brexit deal ‘within reach’

The European Union told Britain on Wednesday to make up its mind on Brexit, putting the onus back on London to unlock trade talks as the bloc’s chief negotiator said an agreement was still within reach with 10 weeks to go.

A frustrated European Union and piqued Britain both exhorted each other this week to compromise to avoid a disruptive finale to the five-year Brexit drama that would add to economic pain from the coronavirus crisis.

“Time is very short and we stand ready to negotiate 24/7, on all subjects, on legal texts. The UK has a bit of a decision to make and it’s their free and sovereign choice,” European Council President Charles Michel told the European Parliament.

He said Britain’s answer would determine its level of access to the EU’s internal market of 450 million consumers, adding: “This is just common sense.”

The EU’s Brexit negotiator Michel Barnier told the parliament an agreement was still “within reach”.

“Time is of the essence … Along with our British counterparts, we must find solutions to the most difficult areas,” Barnier said, in comments that pushed sterling higher.

London has this week refused to continue full negotiations, saying the EU must “fundamentally change” its stance.

The bloc sees this as bluff by Prime Minister Boris Johnson but has also extended an olive branch by talking up UK sovereignity, as well as the EU’s openess to discuss intensively, across the board and on specific legal texts.

A UK spokesman said London noted “with interest” Barnier’s comments that touch “in a significant way on the issues behind the current difficulties in our talks”.

Michel stressed the 27 EU members were ready for an abrupt split without a new agreement to avoid tariffs or quotas. He listed three main sticking points in the negotiations: guaranteeing fishing rights and economic fair play, and agreeing ways to settle future trade disputes.

“We don’t need words, we need guarantees,” he said of fair competition safeguards. “Do our British friends want to regulate state aid and uphold high medical standards? If so, why not commit to them.”

“DOORS OPEN”

Michel called for a “binding, independent arbitration” to redress market distortions swiftly, adding that London’s draft new Internal Market Bill – which, if adopted, would undermine Britain’s earlier divorce deal with the EU – only strengthened the bloc’s resolve to ensure tight policing of any new deal.

A deputy head of the bloc’s executive European Commission, Maros Sefcovic, also said London must respect its Brexit settlement with the EU regardless of the outcome of trade talks.

Michel said losing access to British waters would inflict “extraordinary damage” on the EU’s fishing industry and that the bloc was therefore seeking to prolong the status-quo just as London wanted to keep the EU’s market open for UK companies.

“But the UK wants access to the single market while at the same time being able to diverge from our standards and regulations when it suits them. You can’t have your cake and eat it too,” Michel said.

Following Brexit last March, Britain’s current EU trading terms expire in 10 weeks and unfettered commerce can no longer be guaranteed without a new treaty.

Keen to avoid any blame, the bloc is ready to negotiate until mid-November but must then ratify any deal in the European Parliament before time is up.

“Our doors remain open and will remain open until the last day possible,” Barnier said. “But it takes two to reach a deal.”

End Sars protests: People ‘shot dead’ in Lagos, Nigeria

A number of people have reportedly been shot dead or wounded at a protest against police brutality in Nigeria’s biggest city, Lagos.

Witnesses and the rights group Amnesty International said several people were killed and wounded when soldiers opened fire.

The state governor said about 25 people had been wounded but denied there were any fatalities.

An indefinite 24-hour curfew has been imposed on Lagos and other regions.

Protests over a now-disbanded police unit – the Special Anti-Robbery Squad (Sars) – have been taking place for two weeks, with demonstrators using the social media hashtag #EndSars to rally crowds.

As tensions continued to rise on Wednesday, police in different districts of Lagos fired shots in the air to disperse protesters defying the curfew, the media reports indicate reports from the capital, Abuja.

Protesters who briefly gathered again at the Lekki toll gate – where Tuesday’s shootings took place – were forced out by police, he adds.

President Muhammadu Buhari has appealed for “understanding and calm”.

In a statement on Wednesday, President Buhari did not directly refer to the shootings, but called on people to have patience as police reforms “gather pace”.

A statement issued by his office said the dissolution of the Sars was “the first step in a set of reform policies that will deliver a police system accountable to the Nigerian people”.

“The presidency wishes to reiterate the full commitment of the Buhari administration to the implementation of lasting police reforms in Nigeria,” it added.

The army has not issued a statement on events in Lekki, but in several Twitter posts it described media reports as “fake news”.

Lagos State Governor Babajide Sanwo-Olu, who visited hospitals on Wednesday, said about 25 people had been wounded in what he described as an “unfortunate shooting incident”.

“We are comforted that we have not recorded any fatality, as against the widespread circulation on social media,” he said, adding that an investigation had been ordered.

However, he contradicted the army, telling the BBC’s Newshour programme that the military had been present at the scene at the time of the shooting despite public assurances that soldiers would not deploy until after the start of a curfew at 21:00.

“I think about seven o’clock or thereabouts there was a small unit of the military that went [to Lekki] and we heard that gunshots were fired,” he said.

President Uhuru gifts Shabana FC with a 62 seater team bus

National Super League side Shabana FC have received a massive shot in the arm head of the 2020/21 season after President Uhuru Kenyatta gifted them with a 62- seater bus.

The bus had been requested by Kisii leaders during a recent meeting with the Head of State at State House, Nairobi. Shabana FC management, players and technical bench were all smiles after receiving a token of Sh5 million on Wednesday

The gods seem to have camped at Shabana’s doorstep as they received another Sh1 million donation from former Prime Minister Raila Odinga.

Further kakamega homeboys Boss Shimanyula offered the team a new set of uniforms.

This came just a day after Tore Bobe skinned AFC Leopards by a solitary goal scored by striker Fred Nyakundi in the first half of the match in a Mashujaa Day clash at the historical Gusii stadium.

An elated Shabana coach Vincent Nyaberi thanked the president and the ODM leader saying the team bus will ease their travelling logistics for home and away matches during this season.“We are grateful for what the President and the former Prime Minister have done to us.

This is the second time the Head of State is donating a bus to a football team after a similar gesture to AFC Leopards in May this year and Nzoia sugar.

Manchester United lost £70m as a direct result of the coronavirus pandemic.

The figures were outlined in United’s 2019-20 financial statement, which took in the period during which English football was closed down completely.

United’s overall revenue was down 18.8% from £627.1m to £509m but part of this was due to the club not qualifying for last season’s Champions League.

In last year’s statement, United had estimated revenues could reach £580m.

“Our focus remains on protecting the health of our colleagues, fans and community while adapting to the significant economic ramifications of the pandemic,” said the club’s executive vice-chairman Ed Woodward.

“Within that context, our top priority is to get fans back into the stadium safely and as soon as possible.”

Jacob Mulee appointed as new Harambee stars coach

Jacob Ghost Mulee has made a return to the National team just a day after Head coach Francis Kimanzi and his entire technical team was shown the door.

Football Kenya Federation (FKF)  confirmed the appointment of Jacob ‘Ghost’ Mulee and has since unveiled him.

The change said to have been informed by the need for a general team restructuring –

 Mulee first assignment is to prepare the team that will face Comoros in AFCON Qualifier match that’s set to be played in November.

Kimanzi left the scene after he masterminded what had been tipped to be an unlikely friendly win against Zambia on October 9 at Nyayo Stadium.

 He was appointed in 2019 to replace Sebastien Migne who he worked with as an assistant coach.

Mulee return reminds Kenyans when national team charges helped to qualify for the 2004 Afcon edition in Tunisia.

He is also credited to have mentored the current J1 League top scorer Michael Olunga and his appointment has provided an opportunity for the duo to work again at national level.

Under Nick Mwendwa Mulee becomes the fifth coach to have been appointed since he took office in 2016.

Stanley Okumbi – February 2016 to October 2017.

Paul Put –  led Kenya to Cecafa title- November 2017 to February 2018.

 Migne who led the country to the 2019 Afcon finals but, a Chan qualifying setback against Tanzania saw him part ways with the team on mutual consent paving the way for Kimanzi’s rise to the helm.

Kimanzi remained in charge from August 2019 to October 20, 2020, and he left just days after Mwendwa had secured another four-year term as the FKF president.

Mulee and his technical bench are expected to help Harambee Stars fight for back-to-back Afcon qualifications with two matches – against Egypt and Togo – already played.
