Raila Odinga, the leader of the ODM, has said that the President and he will not appeal the Court of Appeal’s decision declaring BBI unlawful to the Supreme Court.
During a press conference on Friday morning, Odinga informed journalists that while anyone else is free to go to the Supreme Court, he and the President have altered their focus.
He criticized the Court of Appeal’s decision, claiming that the judges made a mistake in finding the BBI process unlawful.
BBI, he claims, adheres to all legal procedures, including public engagement.
“Even though President Uhuru and I don’t agree with the court’s decision, we respect it so we would not like to take the case forward to the Supreme Court but anyone else is free to do so. When the time is right we will come back to it,” he said.

His remarks come just hours after the BBI Secretariat declared its intention to appeal to the Supreme Court.
Junet Mohammed and Dennis Waweru, co-chairs of the BBI Secretariat, pointed out that the Court of Appeal issued several decisions that must be appealed to a higher court.
“The overriding sentiment is that we must pursue this matter to the very end.. We believe that the Supreme Court has a wider and more encompassing mandate when dealing with matters of national interest than the High Court or Court of Appeal,” BBI Promoter Dennis Waweru said.
