Defense lawyers in an Sh122.3 million fraud case want evidence of slain key witness Jennifer Wambua excluded from the record.
The case is against Lugari MP Ayub Savula, former PS Sammy Itemere, and 28 others.
Milimani Law Courts chief magistrate Wendy Kagendo has however dismissed the defense application.
She has argued that the evidence cannot be thrown out however little the impact is.
Jennifer Wambua was murdered before her evidence was cross-examined.
The defense will have said that it will appeal the court’s ruling.
